The number of employees and the structure of civil servants according to professional titles in public service units is one of the contents that has received much attention from provinces, cities and localities in recent times.
According to a survey conducted by Lao Dong on December 23, the provinces of Ha Giang, Ha Nam, Quang Ngai, and Hai Phong city have proposed amending and supplementing Decree No. 62/2020/ND-CP and Decree No. 106/2020/ND-CP; providing guidance on the number of employees and the structure of civil servants according to professional titles in public service units.
Responding to this proposal, the Ministry of Home Affairs said that in order to promptly institutionalize the Party's policy, in 2023 the Ministry of Home Affairs developed and submitted to the Government a draft Decree amending Decree No. 62/2020/ND-CP and Decree No. 106/2020/ND-CP.
However, in Resolution No. 99/NQ-CP dated July 10, 2023 of the Government promulgating the Government's Action Program to implement Conclusion No. 50-KL/TW dated February 28, 2023 of the Politburo on continuing to implement Resolution No. 18-NQ/TW, the Government directed the amendment and supplementation of Decree No. 62/2020/ND-CP and Decree No. 106/2020/ND-CP according to the roadmap for amending and supplementing the Law on Organization of the Government; Law on Organization of Local Government; Law on Cadres and Civil Servants; Law on Public Employees.
Currently, the Ministry of Home Affairs is presiding over and coordinating with ministries, branches and localities to evaluate and summarize to propose amendments and supplements to the above 4 Laws; at the same time, it serves as a basis for amending and supplementing Decree No. 62/2020/ND-CP and Decree No. 106/2020/ND-CP according to regulations.
Regarding the guidance on civil servant staffing norms, the Ministry of Home Affairs said that this is a task assigned by the Government to ministries managing sectors and fields in Decree No. 62/2020/ND-CP, along with job positions.
However, Resolution No. 18-NQ/TW does not set out the guidance on the number of civil servants in administrative agencies and organizations.
Currently, the Politburo has issued Decision No. 71-QD/TW, according to which the civil servant payroll for the 2022-2026 period will be reduced by 5% compared to 2021.
On the other hand, in the process of developing guidance documents, many ministries and sectors have commented that it is very difficult to set criteria and requirements to determine the staffing standards for civil servants in administrative agencies and organizations.
Accordingly, in the coming time, when amending Decree No. 62/2020/ND-CP, research will be conducted to remove the guidance on the staffing standards for civil servants in administrative agencies and organizations from the tasks of ministries managing sectors and fields.
Regarding the guidance on the number of employees, which is a task assigned to ministries managing sectors and fields in Decree No. 106/2020/ND-CP and Resolution No. 38/NQ-CP, the Ministry of Home Affairs acknowledges the opinions of localities and continues to urge ministries to promptly issue guiding circulars, as a basis for localities to organize implementation.
