On the morning of November 14, the National Assembly discussed in the hall the draft Law on Construction (amended).
Receiving and explaining at the discussion, Minister of Construction Tran Hong Minh affirmed that the opinions raised by delegates are reasonable, viewed from many perspectives and drawn from practice, contributing significantly to perfecting institutions in the field of construction, ensuring the process of organizing and implementing the law is serious and strict.
Regarding construction licensing and construction order management, according to the Minister, there are currently shortcomings. During the implementation of the planning, project appraisal, and technical design steps, the management agency has fully controlled the requirements on scale, investment objectives, structure, and fire safety; however, before implementing, people and businesses still have to apply for a license, which is unreasonable.
To overcome this, the draft Law has amended and supplemented the regulation that only a license is granted for works outside the planning scope or with a scale of more than 7 floors.
For special projects, there is still a need for design consultation but the procedures are simplified, no complicated or elaborate documents are required. At the same time, shorten the implementation period from 30 days to 7-10 days but still ensure safety according to the provisions of Decree 06/2021 on safety of structures, architecture, fire prevention and fighting, electricity and water.
Regarding the project management board model, Minister Tran Hong Minh said that there are currently many types of management boards from the central to local levels, causing resource dispersation. The draft Law only maintains two types of management boards including: Professional management boards at the ministerial/sector/provincial level and project management boards at the commune level. In particular, the commune level can organize a management board or hire consultants if it lacks capacity, the cost can be taken from the project management cost.
Regarding project quality management, according to the Minister, up to now, all steps have been fully implemented from acceptance of each work, according to items, acceptance of phase transfer, completion of phase, acceptance of use, when the warranty period expires and acceptance of equipment...
"This regulation has been clearly demonstrated in the acceptance process and decrees as well as guiding circulars of the construction industry. In recent years, the implementation has been implemented very closely" - the Minister informed.
Regarding a number of cases related to the quality of works such as the Lo River bridge case being investigated by the authorities to clarify the cause, Minister Tran Hong Minh affirmed that legally, currently the legal regulations are complete, the implementation is done by the investor, consulting, supervising, and implementing.

Regarding the opinions of some delegates on construction materials, the Minister said that the construction industry has standards and regulations to use materials that meet the conditions for green, clean and smart urban areas, so it is recommended that when implementing projects, it is necessary to study and apply them to ensure the environment and health of the people.
Along with that, the Minister said that it is necessary to remove construction practice certificates and capacity certificates of enterprises at all levels, to avoid the mechanism of asking - giving, negative towards organizations granting certificates.

"The capacity of enterprises has been affirmed when participating in bidding and bidding, including conditions on capacity, machinery and means, staff qualifications, financial capacity, etc. Therefore, it is not necessary to stipulate the certificate of enterprise capacity" - the Minister affirmed.
Regarding the responsibility of entities in construction activities, Minister Tran Hong Minh emphasized that the draft Law clearly stipulates that investors and consultants must take maximum responsibility for the quality of the project, no longer the situation of "contract for reference only" as before, helping to reduce errors and risks when implementing.
