The delegate said that if inspection is only regulated once a year, violations cannot be detected without the coordination of specialized agencies.

On the afternoon of May 15, the National Assembly discussed in groups the draft Resolution of the National Assembly on mechanisms and policies for private economic development.

Delegate Tran Quoc Tuan (Tra Vinh Delegation) stated that the draft stipulates that inspection and examination of each enterprise, business household, and individual must not exceed once a year, except in cases where there is clear evidence of violation.

According to the delegate, such a regulation is completely suitable to create conditions for the private economy to develop more strongly. However, the delegate is worried that if the regulations are not clear, it will create legal gaps and be easily exploited.

The delegate said that if we want the private economy to develop, we need legal regulations to be designed tightly, openly and issued in the direction of special support to create maximum convenience to help private enterprises truly be the main driving force for growth.

Those regulations need to ensure the harmony of interests of two groups of subjects closely related to private enterprises including the state; consumers and the social community.

"The regulations are absolutely not to support private enterprises but to miss the legitimate rights and interests of these two groups of subjects," the delegate emphasized.

The delegate cited a number of recent incidents that have caused public outrage, such as violations of the law on the production and trading of counterfeit goods, fake milk, fake functional foods, counterfeit drugs, foods mixed with chemicals such as cigarette butts, etc.

These foods cause serious damage to the health of consumers. However, the painful question that society is concerned about and raising is whether people who drink fake milk and eat fake functional foods will be compensated for damages or not?

"In other words, the legitimate rights and interests of consumers protected by law will be forgotten and lost," said the delegate.

Regarding inspection, the delegate said that in reality, there have been a number of enterprises that are likely to violate one of the laws in many different periods of the year.

These include violations of counterfeit goods production, violations of food safety regulations, environmental violations, wastewater treatment, fire prevention and fighting, tax declarations, etc., which are only inspected once a year but without coordination with relevant specialized agencies, the above violations cannot be fully detected.

According to the delegate, it is not advisable to let inspection agencies conduct inspections many times a year, which will take a lot of time for businesses.

In order to avoid missing violations, it is necessary to supplement a coordination mechanism between inspection and examination agencies and other relevant agencies. This helps prevent some dishonest businesses from taking advantage to violate the law.

Delegate Tran Kim Yen (HCMC Delegation) expressed the view that what the private sector can do, the state cannot do.

The delegate gave an example of the fact that after 4 years of collecting car parking fees on 20 routes, Ho Chi Minh City not only did not make a profit but also reported a loss of more than 2.28 billion VND. The delegate said that these should be done by the private sector.

Regarding the business environment issue, delegate Yen said that new businesses and startups really want equality in business.

"Backyard businesses, as well as unclear things, are a major obstacle for businesses to do business properly," said the delegate.
