Reporting to the Ministry of Home Affairs' Electronic Information Portal, Mr. Ho Tan Thanh (character's name has been changed), residing in Ba Dinh, Hanoi, said that he is a civil servant born in 1970, and has paid social insurance since May 2000. Currently, his salary coefficient is 5.08; his responsibility allowance is 0.2.
According to the State's policy on streamlining the administrative apparatus, Mr. Thanh wishes to retire early.
"According to Decree 178/2024/ND-CP, how much will I receive for early retirement benefits? When will I receive my pension and what is the expected pension level?" - Mr. Thanh wondered.
Regarding Mr. Thanh's reflection and recommendation, the Ministry of Home Affairs said that in order to enjoy the early retirement policy as prescribed in Decree No. 178/2024/ND-CP mentioned above, he must be a subject as prescribed in Article 2 of Decree No. 178/2024/ND-CP:
Cadres, civil servants, public employees, and people working under labor contracts in agencies, organizations, units and armed forces due to the reorganization of the apparatus and administrative units at all levels (hereinafter referred to as the reorganization of the apparatus) as prescribed in Article 1 of this Decree, including:
Cadres, civil servants, public employees in leadership, management and civil servants, public employees;
Commune-level cadres and civil servants;
People working under labor contracts according to the provisions of labor law before January 15, 2019 and people working under labor contracts are subject to the same policy as civil servants (hereinafter referred to as employees);
Officers, professional soldiers, workers and defense officials of the Vietnam People's Army;
Officers, non-commissioned officers receiving salaries, police workers and contract workers receiving salaries from the state budget under the People's Public Security;
People working in key organizations.
Cadres who are not eligible for re-election or reappointment to hold positions and titles according to their terms in agencies of the Communist Party of Vietnam, the State, socio-political organizations and cadres who resign at will shall comply with the provisions of other Decrees of the Government.
The Ministry of Home Affairs also said that regarding the calculation of early retirement benefits according to the provisions of Decree No. 178/2024/ND-CP, the Ministry of Home Affairs issued Circular No. 01/2025/TT-BNV dated January 17, 2025 guiding the implementation of policies and regimes for cadres, civil servants, public employees and workers in the implementation of the organizational arrangement of the political system.



Therefore, the Ministry of Home Affairs recommends that Mr. Thanh base on the above instructions to calculate the regime in case of early retirement according to the provisions of Decree No. 178/2024/ND-CP.
