As Lao Dong reported, through the inspection of the implementation of 9 projects/land plots in Hanoi, Ho Chi Minh City and Binh Duong in the period of 2011-2019, the Government Inspectorate (TTCP) pointed out many shortcomings and violations in the implementation of land use purpose conversion, land recovery, land allocation, and implementation of housing projects and commercial centers.
For projects/land plots in Hanoi, the Government Inspectorate requests the Ministry of Public Security to receive information and documents for review, investigation, and handling according to the law for violations of the law, including the following contents:
(1) For the high-rise housing, office and service project at 120 Hoang Quoc Viet, Cau Giay district
The Hanoi People's Committee's approval of land use fees 57,595 billion VND lower than the land use right value approved by the Ministry of Industry and Trade in the enterprise value when equitizing Vietnam Steel Corporation (Vnsteel), the risk of reducing the value of the equitized enterprise will lead to a decrease in state budget revenue.
The encroachment of land by some people has lasted for many years, seriously violating the law on land management and use. Up to now, Vnsteel, Hanoi People's Committee, and relevant agencies have not handled it according to the law, leading to the risk of losing land use rights.
(2) For the Project of Housing, Office and Commercial Service Complex on Phap Van Street, Hoang Liet Ward, Hoang Mai District
Vietnam Agricultural Construction Corporation - JSC contributed capital to establish Phuong Dong Investment Company Limited (Phuong Dong Company) with the use and commercial value of the land use right with annual rental payment, which is not in accordance with regulations, leading to the Hanoi People's Committee reclaiming land, allocating land and allowing Phuong Dong Company to change the purpose of using 14,346.6m² of land to implement the Project, which is not in accordance with the Land Use Plan approved by the Prime Minister in the equitization plan of Vietnam Agricultural Construction Corporation and not in accordance with Resolution No. 82 of 2019 of the National Assembly.
Phuong Dong Company also used 312 apartments for short-term rental and sold them under the form of long-term ownership, which is not in accordance with the land use purpose approved by the Hanoi People's Committee in 2019 and not in accordance with the project investment policy approved by the Hanoi People's Committee in 2018.
(3) For the Investment Project to build a commercial, service and housing Center at 275 Nguyen Trai Street, Thanh Xuan District
From the illegal capital contribution, the Hanoi People's Committee reclaimed 23,380m² of production land of Precision Mechanical Joint Stock Company No. 1, and transferred it to Hung Viet Trading Joint Stock Company in the form of land allocation with land use fee collection to implement the housing project, without compensation or site clearance to auction land use rights according to the provisions of the 2003 Land Law.
Precision Mechanical Joint Stock Company No. 1 transferred 3.2 million shares at Hung Viet Trading Joint Stock Company to Hoang Huy Financial Services Investment Joint Stock Company at par value, without auction or share price appraisal, violating the provisions of Decree No. 09/2009/ND-CP of the Government.
