New proposal on members of the Civil Servants' Disciplinary Council

For civil servants who do not hold leadership or management positions, the Ministry of Home Affairs proposes that the Disciplinary Council consist of 5 members.

In the draft decree stipulating the discipline of cadres, civil servants and public employees who are being consulted, the Ministry of Home Affairs proposes to abolish the Council component as the representative of the Executive Committee of the Trade Union to implement the policy of ending the operation of the union organization in administrative agencies and non-business units under the Conclusion No. 157-KL/TW of May 25, 2025 of the Politburo.

Accordingly, the Ministry of Home Affairs clearly states the Composition of the Council for Disciplinary action against Civil Servants.

For civil servants who do not hold leadership or management positions, the Disciplinary Council has 5 members, including:

The Chairman of the Council is the head or deputy head of the civil servant management agency or the agency assigned to manage civil servants;

1 Council member is the head or deputy head of the agency or unit directly employing the civil servant;

1 Council member is a representative of the Party Committee of an agency or unit directly employing civil servants;

1 Council member is a representative of the agency advising on the organization and staffing of the agency or unit directly employing civil servants;

1 Member and Secretary of the Council is a representative of an agency advising on the organization and staffing of a civil servant management agency or an agency delegated to manage civil servants.

For civil servants holding leadership and management positions, the Disciplinary Council has 5 members, including:

The Chairman of the Council is the head or deputy head of the civil servant management agency or the agency assigned to manage civil servants;

1 Council member is the head or deputy head of the agency or unit directly employing the civil servant;

1 Council member is a representative of a Party organization of a civil servant management agency or an agency delegated to manage civil servants;

1 Council member is a representative of the Party Committee of an agency or unit directly employing civil servants;

1 Member and Secretary of the Council is a representative of an agency advising on the organization and staffing of a civil servant management agency or an agency delegated to manage civil servants.

In addition, the Ministry also clearly states the regulations on members of the Civil Servant Disciplinary Council in some other specific cases.
