The Ministry of Home Affairs proposes to continue applying policies to particularly difficult areas after the merger of administrative units.

The Ministry of Home Affairs is seeking opinions on the draft Decree amending and supplementing a number of articles of Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government on policies for cadres, civil servants, public employees, laborers and salaried earners in the armed forces working in areas with particularly difficult socio-economic conditions.

The draft Decree amends and completes the area of application in Clause 2, Article 1 of Decree No. 76/2019/ND-CP to be consistent and consistent with current regulations (Law on Organization of Local Government No. 72/2025/QH15 and Decree No. 272/2025/ND-CP dated October 16, 2025 of the Government), specifically the area of application: Truong Sa, Hoang Sa and DK1 Special Zones; communes in region III; extremely difficult villages.

In addition, supplement regulations: In case there is a change in administrative boundaries (due to arrangement, separation, merger, consolidation, renaming) for particularly difficult areas, the scope of the area is maintained to continue enjoying policies until there is a new decision from competent authorities, ensuring compliance with reality, especially the arrangement of villages and hamlets..., according to the Party's guidelines and the State's laws.

Amend and complete the subjects of application in Clause 2 and Clause 6, Article 2 of Decree No. 76/2019/ND-CP to be consistent with current regulations (Decree No. 111/2022/ND-CP dated December 30, 2022 of the Government on the implementation of labor contracts and service contracts for some types of jobs in administrative agencies and public non-business units and Decree No. 126/2024/ND-CP dated October 8, 2024 of the Government regulating the organization, operation and management of associations, suitable for later if these Decrees are amended, supplemented or replaced).

Replacing the phrase "commune, ward, town (hereinafter referred to as commune level)" with the phrase "commune level" in Article 2 of Decree No. 76/2019/ND-CP to be consistent with the name and in accordance with the Law on Organization of Local Government No. 72/2025/QH15.

Regarding the effectiveness of the Decree, the draft Decree adds an additional clause to more clearly stipulate cases of working in areas with particularly difficult socio-economic conditions (according to regulations of competent authorities approving the period 2021 - 2025) from July 1, 2025 to December 31, 2025, after arranging administrative units to enjoy policies, including initial subsidy policies), to solve existing problems, obstacles, and developments in practice that localities have proposed many times and in accordance with the provisions of Article 13 of Resolution No. 76/2025/UBTVQH15 dated April 14, 2025 and policies specified in Decree No. 76/2019/ND-CP.
