The brother of Mr. Le Ha Van (character's name has been changed) is the Chairman of the Vietnam Fatherland Front Committee at the commune level. When merging commune-level administrative units, his brother will be transferred to the position of Vice Chairman of the Vietnam Fatherland Front Committee at the commune level from January 1, 2025.
Mr. Van cited the provisions of Article 12 of Resolution 35/2023 stipulating the regime and policies for cadres, civil servants, public employees, and workers when implementing the arrangement of administrative units at district and commune levels.
Accordingly, the salary and leadership position allowance policies and regimes will be retained for those who are allowed to continue working but do not hold previous positions until the end of the election term (for those holding positions due to election) or the end of the term of appointment to leadership and management positions (for those holding positions due to appointment).
In case the remaining term of the election term or appointment term is less than 6 months, the full 6 months will be reserved.
After the retention period expires, salaries and position allowances (if any) will be implemented according to the current position or title or will be decided to retire according to regulations.
"So, my brother, will he be allowed to keep the salary and allowances of the Chairman of the Vietnam Fatherland Front Committee at the commune level until the end of the congress term?" - Mr. Van asked.
Regarding Mr. Van's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
According to the Ministry of Home Affairs, when merging commune-level administrative units, commune-level cadres and civil servants are allowed to retain the regimes and policies on salary and allowances according to the provisions of Clause 1, Article 12 of Resolution No. 35/2023/UBTVQH15 dated July 12, 2023 of the National Assembly Standing Committee on the arrangement of district and commune-level administrative units for the period 2023 - 2030.
At the same time, it is necessary to ensure the following conditions: To remain cadres and civil servants at agencies, units, and organizations in the political system in administrative units after the reorganization according to the provisions of Clause 4 of Instruction No. 26-HD/BTCTW dated November 30, 2023 of the Central Organizing Committee on the implementation of the reorganization of the organization, cadres, civil servants, and public employees of Party agencies, the Fatherland Front, and socio-political organizations in localities implementing the reorganization of district and commune-level administrative units in the period of 2023 - 2030.
Thus, in the case where the Chairman of the Commune-level Fatherland Front Committee is converted to Vice Chairman of the Commune-level Fatherland Front Committee (a non-professional worker), he/she is not eligible for the salary and allowance reservation regime as prescribed in Clause 1, Article 12 of Resolution No. 35/2023/UBTVQH15 above.
