The case involves a plot of land in Lieu Tri village, Binh Nguyen commune, Thang Binh district, formerly a state-run soy sauce and dipping sauce production factory.
In 2007, the District People's Committee auctioned and liquidated assets attached to land and Mr. Tran Minh Trinh (residing in Hoi An City, Quang Nam) won the auction. Mr. Trinh was then issued a red book for a plot of land of 9,105m2, which is production and business land, with a term of use of 50 years.
This plot of land was then transferred to Mr. Nguyen Trung Truc and his wife residing in Hoa Huong ward, Tam Ky city, Quang Nam. And from 2018 to 2019, Mr. Truc completed the paperwork and procedures for donating land for roads, changing the use purpose from production and business land to residential land, dividing plots, and requesting issuance of red books into multiple lots.
At the end of December 2019, Mr. Truc submitted an application to change the land use purpose. After only 4 days (December 31, 2019), the Department of Natural Resources and Environment (NMT) of Thang Binh district made a field inspection record, assessing land use needs and conditions for changing land use purposes.
On the same day, Thang Binh District Department of Natural Resources and Environment issued an official dispatch on the above contents and issued a report on requesting permission to change land use purposes.
Notably, also on December 31, 2019, the People's Committee of Thang Binh district issued a decision allowing the change of land use purpose for the above land plot into a plot with an area of 4,251m2 of residential land and a plot of 1,417m2 of land for production facilities. business, minus a portion of land donation for road construction...
Thang Binh Land Registration Office Branch then made adjustments in Mr. Truc's red book to split the above land plot into 8 new plots. And on that basis, the People's Committee of Thang Binh district on July 7, 2021 signed to issue 8 red books to Mr. Truc and his wife.
Just a few months later, on October 12, 2021, Mr. Nguyen Trung Truc continued to submit an application to split 6 residential land plots into 36 residential land plots.
Thang Binh district inspector then conducted a surprise inspection, pointing out many serious violations and profiteering acts in this case.
In this case, Thang Binh District Inspector discovered that the District Department of Natural Resources and Environment did not use the excerpt of the cadastral map of the land plot or the original cadastral measurement of the land plot and was irresponsible in appraising the documents and advising the District People's Committee to issue them. The decision to allow Mr. Truc to change the purpose of part of the land plot to residential land does not ensure the provisions of Clause 1, Article 52 of the 2013 Land Law.
Furthermore, even though there is no land use plan approved annually by competent authorities, the District Department of Natural Resources and Environment still advises the District People's Committee to issue 8 red books to Mr. Truc.
With the above serious violations, the inspection agency recommended and the People's Committee of Thang Binh district then decided to revoke the 8 red books issued to Mr. Truc and his wife.
On August 18, according to the Government Electronic Information Portal, a notable development was that the Chairman of Thang Binh District People's Committee had just officially signed a document transferring the case file to the Police Investigation Agency for further consideration and handling according to the Government's website. jurisdiction over the above violations.
