Mr. Le Van Thanh (character's name has been changed) has had questions related to policies and regimes for cadres, civil servants, public employees (CBCCVC), workers and armed forces in implementing the organizational arrangement of the political system according to the provisions of Decree No. 178/2024 dated December 31, 2024.
Before August 2024, Mr. Thanh worked at a primary school in Tuyen Hoa district, Quang Binh province and held the position of principal. From August 8, 2024, this unit will merge with a secondary school unit also in the district.
At that time, Mr. Thanh was assigned by the District People's Committee to hold the position of deputy principal. After the merger, the school where he worked had 3 vice principals and Mr. Thanh was a redundant cadre.
"Now I want to retire according to the regime in Decree 178, are I eligible? We hope that the Ministry of Home Affairs will respond" - Mr. Thanh suggested.
Regarding Mr. Thanh's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
The Ministry of Home Affairs said that on March 15, 2025, the Government issued Decree No. 67/2025 amending and supplementing a number of articles of Decree No. 178/2024 on policies and regimes for civil servants, employees and armed forces in implementing the organizational arrangement of the political system, in which the subjects of Decree No. 178/2024 have been specifically regulated.
According to Decree 67/2025 (amended and supplemented by Decree 178/2024), the first group to be added to the early retirement policy is CBCCVC leaders and managers who wish to quit their jobs to facilitate the arrangement of CBCCVC leaders and managers.
The second group is civil servants, public employees, employees receiving salaries from the state budget before January 15, 2019 and armed forces with at least 5 years left until retirement age, not directly affected by the organizational arrangement, but must streamline the payroll, restructure, and improve the quality of the team.
The third group is the person who works in the payroll and salary targets from the State budget at the Associations assigned by the Party and the State at the central level, at the provincial level, at the district level to be directly affected by the implementation, consolidation and merger of the organizational structure.
The fourth group is that officials who are not old enough to re -election and re -appointment; Officials who are eligible for the age of re -election and re -appointment of the party committees of the same level, have a working time from the beginning of the meeting to organize the Congress from 2.5 years (30 months) to 5 years (60 months) to the retirement age and officials participating in the Party committees must end the activity, consolidate the organizational apparatus to 5 years or less to retire, have the desire to retire before the Party Committee of the Party Committee to create conditions XIV's XIV was agreed by the competent authorities.
At the same time, based on Articles 17 and 19, Decree No. 178/2024 (amended and supplemented by Decree No. 67/2025), the agreement for officials and employees to rest and enjoy policies and regimes as prescribed in Decree No. 178/2024 under the authority of the heads of agencies, organizations and units with the Party committees and authorities of the same level.
Therefore, the Ministry of Home Affairs has asked Mr. Thanh to study the above regulations to determine whether he is eligible for the policy according to the provisions of Decree No. 178/2024 or not.
