The Ministry of Justice is reviewing the draft Decree guiding the collection of public opinions on the establishment, dissolution, merger, division, adjustment of boundaries and renaming of administrative units, which will be developed by the Ministry of Home Affairs.
The draft Decree clearly states the establishment, dissolution, merger, division, adjustment of boundaries and renaming of administrative units that are allowed to consult households according to the provisions of Article 25 of the Law on Implementing Democracy at the Grassroots Level.
In case of establishing, dissolving, merging, dividing, adjusting the boundary and renaming the provincial administrative unit, the provincial People's Committee will organize a consultation with households in all commune-level administrative units under that provincial-level administrative unit.
In case of establishing, dissolving, merging, dividing, adjusting the boundary and changing the name of the commune-level administrative unit, the provincial People's Committee will organize a consultation with the household in that commune-level administrative unit.
Commune-level People's Committees organize public consultation by distributing Household Consultation F formats according to the Form prescribed in the Appendix issued with this Decree.
Commune-level People's Committees organize the distribution of votes to each household in forms suitable to the specific conditions of the locality, ensuring the provisions of law on implementing democracy at the grassroots level.
Regarding the budget for organizing the collection of public opinions on the project of establishing, dissolving, merging, dividing, adjusting boundaries and renaming administrative units, the Ministry of Home Affairs proposes to ensure the state budget according to the decentralization of the law on the state budget.
The Ministry of Home Affairs inspects and guides People's Committees at all levels in collecting public opinions on the project of establishing, dissolving, merging, dividing, adjusting boundaries and changing administrative names in specific cases.
The People's Committee at the provincial level is responsible for organizing the collection of public opinions on the policy of establishing, dissolving, merging, dividing, adjusting boundaries and changing administrative names; guiding, inspecting, allocating funds and ensuring necessary conditions for the People's Committee at the commune level in collecting public opinions according to the provisions of this Decree and assigning the People's Committee at the provincial level.
Ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of People's Committees of provinces and centrally run cities and related organizations and individuals are responsible for implementing this Decree when it is issued.
