Expected to collect allowances for commune-level leaders before January 1, 2026

The Ministry of Home Affairs proposes regulations on the collection of allowances for commune-level leadership positions and social insurance collection according to the leadership position allowance coefficient.

The Ministry of Justice is reviewing the draft Decree amending and supplementing a number of articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces.

The draft decree drafted by the Ministry of Home Affairs is expected to take effect from January 1, 2026, in accordance with Conclusion No. 206-KL/TW of the Politburo.

The draft resolution clearly states the removal of inappropriate regulations in relevant legal documents.

Specific regulations on the implementation of allowances for leadership positions of commune-level People's Committees from July 1, 2025 to before January 1, 2026 and allowances for leadership positions of Departments under the Ministry from March 1, 2025 to before the date of the decision to classify the Department.

Continue to retain the old leadership position allowance until the end of the prescribed time for the leadership position of the People's Committee at the commune level that is retaining the leadership position allowance according to the regulations of the competent authority, with the leadership position allowance coefficient being higher than the leadership position allowance coefficient prescribed in this Decree.

The Ministry of Home Affairs proposes that for the leadership position of the People's Committee at the commune level from July 1, 2025 to before January 1, 2026, who have not yet enjoyed the leadership position allowance coefficient or are being retained (maintained) the leadership position allowance coefficient due to the impact of the arrangement of administrative units but are lower than the leadership position allowance coefficient, they will be allowed to receive the leadership position allowance and pay social insurance according to the leadership position allowance coefficient as prescribed in the Decree.

For the leadership position of a Department under the Ministry from March 1, 2025 to before the date of the decision to classify the Department that is temporarily applying the leadership position allowance or is being reserved the leadership position allowance coefficient due to the impact of the restructuring of the apparatus, the leadership position allowance will be applied to a Type 2 Department and the leadership position allowance will be repaid and social insurance will be paid according to the leadership position allowance coefficient as prescribed in the Decree.
