Circular No. 19/2025/TT-BQP of the Ministry of Defense guiding the implementation of policies and regimes for subjects under the management of the Ministry of Defense in organizing the organizational structure.
According to Article 5, how to determine the time and age limit to calculate the regime and policies are guided as follows:
1. The number of months of retirement before the age to calculate the 1 -time retirement allowance for early leave is the month from the month of the monthly pension entitlement under the decision of the competent authority compared to the instruction age limit at Point a, Point b, Clause 5 of this Article; No more than 60 months.
2. The number of years of retirement before the age to calculate the allowance for the number of years of early break is the number of years from the month of enjoying the monthly pension under the decision of the competent authority compared to the age limit at Point a, Point b, Clause 5 of this Article; If there is an odd number of months, it will be rounded according to the principle: From 1 month to 6 months is 0.5 years; From over 6 months to less than 12 months, it is 1 year.
3. Time to calculate the benefits of the uniform and severance allowance at Point a, Clause 1, Article 10, Point a, Clause 1, Article 11 and Point a, Clause 1, Article 12 of this Circular complies with Clause 2, Article 5 of Decree No. 178/2024/ND-CP; No more than 60 months.
4. The time for calculating the allowance according to the number of years of work with compulsory payment of social insurance (social insurance) guides at Point b, Points c, Clause 1, Point b, Point c, Clause 2, Article 6; Point b, Clause 1, Article 10, Point b, Clause 1, Article 11, Point b, Clause 1, Article 12 of this Circular complies with Clause 3, Article 5 of Decree No. 178/2024/ND-CP.
5. How to determine the highest service age or retirement age for subjects to calculate the policy and retirement regime before the age:
The highest service age:
For officers: Lieutenant 50; Major 52, Lieutenant Colonel 54; Lieutenant Colonel 56; Colonel 58; General level 60.
For professional military personnel: The level of a lieutenant for men and women is 52 years old; Major, Lieutenant Colonel of professional soldiers for men and women are 54 years old; Senior Lieutenant Colonel professional for men is 56 years old, female is 55 years old.
For defense workers, defense officers: Male enough 60 years old, female full 55 years old.
Retirement age:
For defense officials; Contract labor earning salary from the state budget; officer; officials comply with the provisions of the Law on Social Insurance No. 41/2024/QH15; Appendix I and Appendix II issued together with the Government's Decree No. 135/2020/ND-CP of November 18, 2020 stipulating retirement age.
For people working in the Cipher Organization of the Government Cipher Committee comply with Clause 1, Article 27 of the Cipher Law No. 05/2011/QH13; Appendix I and Appendix II issued together with Decree No. 135/2020/ND-CP.
Military rank to determine the highest age limit for professional officers and soldiers:
The rank of the rank to determine the highest age limit is the rank of army ranks of officers and professional soldiers stated in the retirement decision (resting) of the competent authorities.
How to determine the age of retirement cases before age:
Age to determine the cases of retirement before the age of the highest service age or the retirement age according to the instructions at Point a, Point B of this Clause are counted from the month of birth to the adjacent month before enjoying the monthly pension.
