On October 9, according to the Government Electronic Information Portal, the Ministry of Public Security has just announced the removal of the regulation on publicizing patrol and control plans.
Accordingly, the Ministry of Public Security has just issued Circular No. 46/2024/TT-BCA abolishing Point d Clause 1, Point c Clause 2, Point b Clause 3 Article 5 of Circular No. 67/2019/TT-BCA related to the public content of the People's Public Security (CAND) in the work of ensuring traffic order and safety.
The new circular abolishes the disclosure of the contents of the general traffic control plan, thematic traffic patrol, control and violation handling plan, and regular patrol, control and violation handling plan, including the following specific contents: Name of unit; route; types of vehicles and violations to be controlled and handled; implementation time in patrol, control and administrative violation handling.
At the same time, abolish the public disclosure of uniforms and police numbers of officers in charge of vehicle registration and license plate issuance in the work of vehicle registration and license plate issuance. Abolish the public disclosure of uniforms, police numbers and technical means and supporting tools that are made public according to regulations in the work of traffic command and control.
Regarding this issue, the Traffic Police Department said that in addition to ensuring traffic safety and order, the activities of the traffic police force also directly or in coordination with professional forces carry out crime prevention and control work on traffic routes. Therefore, the work plan is a confidential or internal document within the force.
Previously, Circular No. 32/2023/TT-BCA of the Ministry of Public Security dated August 1, 2023 regulating the tasks, powers, forms, contents and procedures for patrolling, controlling and handling administrative violations of road traffic by traffic police (effective from September 15, 2023, replacing Circular No. 65/2020/TT-BCA dated June 19, 2023) also abolished the content of public announcement of patrol and control plans prescribed in Circular No. 65/2020/TT-BCA;
Circular No. 36/2023/TT-BCA dated August 2, 2023 of the Minister of Public Security regulating the process of patrolling, controlling and handling administrative violations of the waterway police in Clause 2, Article 5 also stipulates that "The content of the Waterway Patrol and Control Plan is managed according to the confidential document regime".
In addition, the Traffic Police Department said that in the process of implementing the tasks of the Traffic Police force, many people have asked the Traffic Police force to present patrol and control plans and share them on social networks with the aim of harassing and causing difficulties for law enforcement on traffic order and safety and the fight against crime on traffic routes.
