Recommendation on allowance of Head of People's Inspectorate

Ministry of Home Affairs information on the allowances of the Head of the People's Inspectorate.

After the 7th session of the 15th National Assembly, the Ministry of Home Affairs received comments from the National Assembly Delegation of Khanh Hoa province.

Voters in Khanh Hoa province said that, based on Article 37 of the Law on Grassroots Democracy, members of the People's Inspection Board cannot be commune-level officials, civil servants, or part-time workers at the commune, village, or residential group levels. According to regulations, the functions and tasks of the People's Inspection Board are numerous but they do not receive allowances.

"It is proposed to study the regulation that the Head of the People's Inspectorate is entitled to receive allowances like the Branch Heads of socio-political organizations in the village (coefficient of 0.3 times the basic salary) to link the responsibility of the Board with the tasks to be performed" - voters suggested.

Regarding this content, the Ministry of Home Affairs in an official dispatch responding to voters of Khanh Hoa province, said:

The Law on Grassroots Democracy Implementation 2022 stipulates:

(1) The People's Committee at the commune level is responsible for supporting operating costs for the People's Inspectorate.

(2) The Vietnam Fatherland Front Committee at the commune level is responsible for supporting operating costs for the Community Investment Supervision Board.

(3) The Ministry of Finance guides the preparation of estimates, management, use and settlement of funds for implementing democracy at the grassroots level and the allocation of funds to the Committee of the Vietnam Fatherland Front and the Vietnam General Confederation of Labor to support the operating costs of the People's Inspectorate and the Community Investment Supervision Board.

Decree No. 59/2023/ND-CP dated August 14, 2023 of the Government detailing a number of articles of the Law on Implementing Democracy at the Grassroots Level stipulates: The Standing Committee of the Central Committee of the Vietnam Fatherland Front directs and guides the implementation of regulations on the organization and operation of the People's Inspection Committees in communes, wards and towns and the Community Investment Supervision Committee.

In addition, Circular No. 40/TTr-MTTW-BTT dated March 26, 2024 of the Central Committee of the Vietnam Fatherland Front stipulated: Funds to support the activities of the People's Inspectorate, monthly support for the Head of the People's Inspectorate are used from the state budget according to the annual estimates and plans of the Vietnam Fatherland Front Committee at the commune level, because the state budget at the commune level ensures the preparation of estimates, management, use and settlement of funds allocated to the Vietnam Fatherland Front Committee at the commune level to support operating costs for the People's Inspectorate in accordance with the guidance of the Ministry of Finance.

The Ministry of Home Affairs believes that, according to the above regulations, the operating costs of the People's Inspectorate and the Community Investment Supervision Board have been guaranteed by the state budget.
