The Nha Trang - Cam Lam expressway project has caused cracks in the houses of some households, and there is no compensation or support policy, causing frustration among the people.

On the afternoon of October 20, National Assembly Standing Committee member Duong Thanh Binh presented a Report on the results of monitoring the settlement of voters' petitions sent to the 9th Session of the 15th National Assembly.

Mr. Binh said that through meetings with voters of National Assembly deputies, 1,472 petitions were compiled and sent to competent authorities for settlement, 1,433 petitions were resolved and responded to, reaching 97.4%.

Of which, the National Assembly and its agencies have received and responded to 39/39 petitions, reaching 100%, the Government, ministries and central branches have resolved and responded to 1,372/1,410 petitions, reaching 97.3%.

In addition to the achieved results, there are still some limitations and recommendations.

According to the report, before the 9th Session of the 15th National Assembly, voters of Khanh Hoa province reflected: During the construction of the Nha Trang - Cam Lam expressway project, cracks were caused in the houses of some households but there were no compensation and support policies, causing frustration for local people and authorities.

Monitoring shows that since 2023, voters have petitioned for compensation and support. On October 26, 2023, Cam Lam District People's Committee sent a document to the Ho Chi Minh Road Project Management Board requesting to resolve the cracked house in Suoi Dau Commune (formerly Suoi Cat Commune) due to the construction of the North - South Expressway.

The district's specialized agency also inspected and recorded with the naked eye cracks in the house and proposed handling. However, due to not being resolved, the People's Committee of Cam Lam district continued to repeatedly send documents to relevant agencies requesting handling.

After that, the Ho Chi Minh Road Project Management Board issued many documents requesting the project enterprise to urgently resolve the issue. However, up to now, there are still problems due to disagreements between the parties: Suoi Dau Commune People's Committee and the people confirmed that the construction caused cracks in the house, while the project enterprise denied it.

The incident has been prolonged and has not been completely handled, causing outrage among the people. Therefore, after the 9th Session, the National Assembly Delegation of Khanh Hoa province continued to receive recommendations on this content. Propose that the Ministry of Construction urgently direct the inspection, review, and final settlement of voters' petitions.

Proposal to supplement regulations on administrative sanctions for small-scale petroleum points

At the 9th Session, voters reflected that Decree No. 99 regulating administrative sanctions for violations in the fields of oil and gas, petroleum and gas trading has not yet regulated sanctions for small-scale petroleum points, and proposed to add regulations on administrative sanctions for this petroleum point.

The Ministry of Industry and Trade has responded to the opinions of voters to study and supplement during the process of developing a Decree amending and supplementing Decree No. 99.

The introduction of small-scale petroleum sales equipment business is to facilitate people in remote areas to easily access petroleum supplies. However, up to now, there is still a lack of regulations to regulate this type of business, creating legal gaps that make it difficult to apply the law.

Although the Ministry of Industry and Trade has proposed to voters to regulate the responsibility of traders for small-scale petroleum points, it has been accepted in the draft Decree on petroleum trading to replace Decree No. 83. However, this draft Decree has been posted on the Government's Information Portal to collect opinions from agencies, organizations and individuals since March 29, 2024, but it has been more than 18 months since the Decree replacing Decree No. 83 has been issued.

In addition, through supervision, it is found that in reality, the selling point using small-scale petroleum equipment only needs to send a notice to the local Department of Industry and Trade, without needing to apply for a license, so many violations are very difficult to handle if " machinery" is applied according to current regulations. Therefore, voters' opinions that the legal system lacks regulations on individual sanctions for violations for this type of business are well-founded.

Propose that the Ministry of Industry and Trade review all legal regulations on small-scale petroleum points to amend and supplement them to suit reality.
