The Government has issued Decree 67/2025/ND-CP on amending and supplementing a number of articles of Decree 178/2024/ND-CP on policies and regimes for cadres, civil servants, public employees (CBCCVC), workers and armed forces in implementing the restructuring of the apparatus of the political system.
Among the 5 subjects receiving severance pay according to Decree 178, there are CBCCVC leaders and managers in agencies, organizations and units who wish to quit their jobs to facilitate the arrangement of the number of CBCCVC leaders and managers according to the provisions of law in implementing the arrangement of the apparatus of the political system.
The Ministry of Home Affairs then issued Official Letter 1814/BNV-TCBC in 2025 guiding the assessment and review of cases of voluntary application for early retirement or resignation from work as civil servants and public employees.
Accordingly, in the case of civil servants and public employees who voluntarily apply for early retirement or resignation, it is also necessary to conduct an assessment and review according to the criteria to determine the retired subjects according to the provisions of Decree 178/2024/ND-CP.
Article 6 of Decree 178/2024/ND-CP stipulates criteria for evaluating civil servants and employees to implement the restructuring of the apparatus, streamlining the payroll and restructuring, improving the quality of cadres and civil servants and resolving policies and regimes.
Based on the above guidance, the collective of the Party Committee, the authorities and the heads of each agency, organization and unit must conduct a review and evaluation of all officials and employees and employees under the management scope based on the results of performing tasks in the last 3 years according to criteria such as moral qualities, responsibility and sense of responsibility; Criteria for assessing professional and professional capacity; Criteria for evaluating results and work products associated with the functions and tasks of agencies, organizations and units that cadres, civil servants and employees have achieved.
Based on the above regulations and instructions, many localities have recently issued instructions to seriously implement policies and regimes related to the arrangement of the apparatus according to the direction of the Government and the Ministry of Home Affairs.
Notably, in Dak Lak province, in the process of restructuring the apparatus, the Provincial People's Committee requires that if there are voluntary cadres applying for retirement or quitting their jobs, agencies need to carefully review to identify the right subjects, not resolve the termination of employment for cases with outstanding abilities, meeting job requirements.
Accordingly, regarding the dossier and procedures for proposing the Provincial People's Committee to approve the list of policy beneficiaries, in addition to the prescribed dossier list, there must also be a report on the results of the assessment and review according to the prescribed criteria of each individual.
Agencies, units and localities are responsible for evaluating and reviewing according to the criteria for determining the retiree according to regulations to propose the Provincial People's Committee to approve the list of retirees and severance pay and to effectively manage documents to implement policies and regimes to serve the inspection work of competent authorities in the future.
The Hanoi People's Committee previously also issued Instruction No. 01, which did not consider or resolve cases of voluntary applications for early retirement or resignation but were assessed as having outstanding qualities and abilities, daring to think, daring to do, daring to take responsibility for the common good, having outstanding achievements, bringing benefits to agencies, organizations, and units.
