Mr. Pham Van Tien (character's name has been changed) has 5 years of being a Emulation Fighter at the grassroots level (2019, 2020, 2022, 2023, 2024).
In 2015, he was awarded a Certificate of Merit by the Prime Minister, and has completed his tasks well every year.
In 2025, Mr. Tien proposed to award the Third Class Labor Medal and the Provincial Emulation Fighter, but the Department of Organization and Personnel where he worked said that he was not eligible to be awarded the Third Class Labor Medal.
Mr. Tien said that the Department of Organization and Personnel replied that if the achievement of 3 years of Emulation Fighters at the grassroots level from 2022-2024 is used to award the Provincial Emulation Fighter, there will only be 2 years left of Emulation Fighters at the grassroots level in 2019 and 2020, which is not enough to award the Third Class Medal.
"I wonder where that regulation is because I read the latest Emulation and Commendation Law and there is no such content" - Mr. Tien asked.
Regarding Mr. Tien's reflection and recommendation, the Ministry of Home Affairs responded on the Ministry of Home Affairs' Electronic Information Portal.
At Point e, Clause 1, Article 44 of the Law on Emulation and Commendation stipulates one of the criteria for awarding or posthumously awarding the Third Class Labor Medal to individuals as follows: Having been awarded the "Certificate of Merit of the Prime Minister" and then continuously for 5 years or more until the time of requesting to be recognized for completing the task well or better, during that time, for 1 year or more being recognized for completing the task excellently and having been awarded the title of "Emulation Fighter at the grassroots level" 3 times.
Therefore, based on the provisions of law and practical situation, the consideration of awarding the Third Class Labor Medal to individuals must be based on the specific conditions and standards that have been prescribed above;
At the same time, ensure the general principles stipulated in Clause 2, Article 5 of the Law on Emulation and Commendation.
In which, Clause 2, Article 5 of the Law on Emulation and Commendation stipulates that the consideration of commendation must be accurate, public, transparent, fair and timely; Ensuring consistency between the form, subject of commendation and merits and achievements;
A form of reward can be given many times to a subject; no multiple rewards, many forms for an achievement; the achievement is rewarded as much as it is.
