Resolution on severance allowance for part-time workers at the commune, village, hamlet and residential area levels in Phu Yen province who quit their jobs at their own will; quit their positions before the end of their term or when they are not re-elected or not elected at the end of their term.
The regulation applies to non-professional workers with a working period of 60 months or more and in the following cases:
Holding non-elected positions, wishing to resign and being dismissed by a competent authority; Holding elected positions and being dismissed by a competent authority before the end of the term.
Holding positions under the election system but at the end of the term not being re-elected, not being elected and being confirmed by the competent authority to have ceased to hold the position.
This regulation does not apply to non-professional workers who have received redundancy support policies due to the arrangement of commune-level administrative units; are receiving retirement benefits or labor capacity loss allowances; voluntarily quit their jobs; and are disciplined in the form of forced resignation or dismissal.
Non-professional workers who pass the exam and are recruited as civil servants or public employees; are elected to hold positions as commune-level officials or are arranged and assigned to other jobs.
Part-time workers at the commune level after leaving their jobs are eligible for retirement benefits. Deputy Commanders of the Commune Military Command and Vice Presidents of the Commune Veterans Association when leaving their jobs are entitled to severance benefits according to specialized laws.
Regarding the level of allowance, non-professional workers who have not met the prescribed standards and wish to quit their jobs before the deadline for completing the standards; holding positions under the election regime at the end of their term but are not re-elected or not elected, will receive a one-time severance allowance according to the number of years of service (enjoying 1 month of current allowance/1 year), including: Allowance level, additional allowance, seniority allowance.
Non-professional workers who wish to quit their jobs or leave their positions before the end of their term or leave their jobs due to not meeting the standards will be entitled to a one-time severance allowance based on the number of years of service (0.7 months of current allowance/1 year), including: Allowance level, additional allowance, seniority allowance.
The budget for implementing the severance allowance regime is guaranteed by the district and commune budgets according to current budget decentralization.
On December 11, speaking with Lao Dong, the leader of the Department of Government Construction and Youth Affairs, Department of Home Affairs of Phu Yen province said that the Provincial People's Council has just passed this resolution. After the resolution is issued, eligible subjects will receive severance allowance according to regulations.
"This Resolution stipulates the severance regime for non-professional workers at the commune, village, hamlet and residential area levels in the province, not applicable to commune-level cadres and civil servants. Therefore, these subjects will not be affected by the work of restructuring and streamlining the provincial apparatus.
If part-time workers at the commune, village, hamlet, or neighborhood level quit their jobs at will or quit their jobs in cases subject to applicable regulations, they will receive severance pay, whether before or after the organization is reorganized or streamlined," he said.

Previously, the People's Council of Phu Yen province issued Resolution No. 10/2024/NQ-HDND on regulations on support policies for commune-level cadres, civil servants, and non-professional workers at the commune, village, and residential area levels who are redundant due to the rearrangement of commune-level administrative units in the 2023-2025 period in the province.
The subjects of application are commune-level cadres and civil servants who are redundant due to the reorganization of commune-level administrative units in the 2023-2025 period, who are dismissed by competent authorities within 24 months, and non-professional workers at the commune, village, and residential area levels who are redundant due to the reorganization of commune-level administrative units in the 2023-2025 period, who are dismissed by competent authorities within 12 months, from the effective date of Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee...
