Hanoi and Ho Chi Minh City are allowed to increase by no more than 10 Deputy Directors
The Government has just issued Decree No. 370/2025/ND-CP amending regulations on heads and deputy heads of departments and the number of deputy heads of department-affiliated organizations.
At the time of arranging the state apparatus, the number of deputy heads of agencies, organizations, and units may be more than the prescribed number.
No later than 5 years from the date the decision to rearrange the organizational structure of the competent authority takes effect, the number of deputy heads of agencies, organizations, and units after rearrangement shall be implemented in accordance with regulations, specifically as follows:
The number of Deputy Directors of departments assigned is an average of 3 people/department;
Departments implementing consolidation and merger when implementing the consolidation and merger of 2 provincial-level administrative units, the number of Deputy Directors of departments is increased by 1 person or when implementing the consolidation and merger of 3 provincial-level administrative units, the number of Deputy Directors of departments is increased by 2 people compared to the number of Deputy Directors of departments specified above;
In case the department implements merger and acquisition according to the decision of the competent authority, the number of Deputy Directors of the department after merger and acquisition can be increased by 1 person;
In case the department implements merger and acquisition according to the decision of the competent authority and continues to implement merger and acquisition when implementing the merger and acquisition of 2 provincial-level administrative units, the number of Deputy Directors of the department is increased by 2 people or the merger and acquisition of 3 provincial-level administrative units, the number of Deputy Directors of the department is increased by 3 people compared to the number of Deputy Directors of the department compared to regulations;
In case special departments do not implement consolidation and merger when implementing the consolidation and merger of provincial-level administrative units, the number of Deputy Directors of departments shall be implemented according to regulations.
For Hanoi and Ho Chi Minh City: In addition to the total number of Deputy Directors as prescribed, an increase of no more than 10 Deputy Directors is allowed;
Based on the criteria and principles for determining the number of deputy heads specified in this Decree, the Provincial People's Committee determines the total number of deputy heads of agencies, organizations, and units under management and decides on the specific number of deputy heads of each agency, organization, and unit according to its authority.
Number of Deputy Heads of professional and nghiep vu departments under the department
Departments under the department with less than 10 civil servant positions are assigned 1 Deputy Head of Department; there are from 10 to 14 civil servant positions are assigned no more than 2 Deputy Heads of Department; there are from 15 civil servant positions or more are assigned no more than 3 Deputy Heads of Department;
Departments implementing consolidation and merger when implementing the consolidation and merger of departments according to regulations, the number of Deputy Heads of Departments is increased as adjusted for the number of Deputy Directors of Departments.
Sub-departments under the department with 1 to 3 rooms and equivalents are arranged with 1 Deputy Head of Sub-Department; without rooms or with 4 rooms and equivalents or more are arranged with no more than 2 Deputy Heads of Sub-Departments;
Sub-departments implement consolidation and merger. When implementing the consolidation and merger of departments according to regulations, the number of Deputy Heads of Sub-departments is increased as for Deputy Heads of Departments.
