The process of merging the two laws, building the Law on Cyber Security in the spirit of streamlining

The draft Law on Cyber Security is built on the basis of merging two current laws, ensuring streamlining the apparatus, not creating new policies, and not overlapping functions.

The draft Law on Cyber Security was developed on the basis of merging the Law on Cyber Security 2018 and the Law on Cyber Information Security 2015 on the principle of not changing the functions and tasks of ministries and branches, not creating new policies; ensuring the correct implementation of the spirit of Resolution No. 18 of the Central Executive Committee on a number of issues to continue to innovate, reorganize the apparatus of the political system to be streamlined, effective and efficient, which is "one task assigned to only one agency in charge, taking primary responsibility", ensuring clear assignment and decentralization to avoid overlapping functions, tasks, management scope, and omission of the area.

In the process of developing the draft Law, the drafting agency has closely followed the conclusion of the National Assembly Standing Committee, only stipulating in this Law the contents within the authority of the National Assembly, not regulating issues under the authority of the Government, ministries and other agencies, not re-regulating the contents that have been stipulated in other laws; for new issues that have been subject to regular and unstable fluctuations, only regulating the framework, in principle and assigning the Government and ministries to regulate.

Implementing the direction of the Prime Minister, the Ministry of Public Security has developed a dossier to propose the development of a Law on Cyber Security according to the provisions of the Law on Promulgation of Legal Documents.

According to Resolution No. 87/2025/UBTVQH15 dated July 10, 2025 on adjusting the legislative Program, the National Assembly Standing Committee has added the draft Law on Cyber Security to the 2025 legislative Program and allowed it to be carried out in a shortened order and procedure.

Although it was developed according to a shortened order and procedure, during the process of developing the Law project, the Ministry of Public Security still collected public opinions on the Ministry of Public Security's Electronic Information Portal from June 28, 2025 to July 13, 2025 and is currently continuing to record the participation of agencies, organizations and enterprises.

On August 1, 2025, the Ministry of Public Security issued Official Letter No. 3435/CV-BCA requesting ministries and ministerial-level agencies; the Supreme People's Court; the Supreme People's Procuracy; the Central Committee of the Vietnam Fatherland Front; People's Committees of provinces and cities (total of 58 focal points) to give opinions on the draft Law dossier.

On August 15, 2025, the Ministry of Justice held an appraisal meeting with the draft Law on Cyber Security. On August 22, 2025, the Ministry of Justice issued Appraisal Report No. 366/BC-BTP on the dossier of the Cyber Security Law project. Based on the appraisal opinion, the Ministry of Public Security has completed the dossier of the draft Law to submit to the Government.

On August 29, 2025, the Ministry of Public Security issued Document No. 514/TTr-BCA to the Government on the draft Law on Cyber Security. On September 3, 2025, the Government Office issued No. 728/PLYK/2025 on the Draft Law dossier. On the afternoon of September 4, 2025, at the Government Session on Law Development in August 2025, the Government reviewed and gave opinions on the draft Law on Cyber Security.

On September 22, 2025, the Government issued Document No. 815/TTr-CP to the National Assembly on the draft Law on Cyber Security.

Previously, on September 19, 2025, the Standing Committee of the National Defense, Security and External Affairs Committee held a meeting of the Standing Committee of the Expanded Committee to review the draft Law on Cyber Security. Based on the preliminary review report No. 944/BC-UBQPANDN15 dated September 23, 2025, the Ministry of Public Security has expected the contents to be accepted and explained on the draft Law on Cyber Security.

On September 23, 2025, at the 49th Session, the National Assembly Standing Committee met to give opinions on the draft Law on Cyber Security, accordingly, the National Assembly Standing Committee highly appreciated the Government and the drafting agency, the Ministry of Public Security, for proactively and urgently completing the draft Law, ensuring the spirit of openness and full content according to regulations. Based on the Conclusion of the working session in Notice No. 3513/TB-VPQH dated September 25, 2025, the Ministry of Public Security has expected the contents to be accepted and explained on the draft Law on Cyber Security.

On October 4, 2025, the 8th National Assembly Delegation Conference on full-time activities, term XV, discussed a number of contents submitted to the National Assembly at the 10th Session of the 15th National Assembly, including the Draft Law on Cyber Security. Based on 01 opinion expressed at this conference, the drafting unit has studied and accepted the draft law.

On October 10, 2025, the National Assembly's Committee for National Defense, Security and External Affairs held a meeting to review the entire draft Law on Cyber Security. At the meeting, the National Assembly's Committee on National Defense, Security and External Affairs highly appreciated the Government and the unit in charge of advising is the Ministry of Public Security. For the contents that have not yet agreed with the Ministry of National Defense, the Vice Chairman of the National Assembly proposed assigning the Government to continue to agree.

At the 10th Session of the 15th National Assembly, National Assembly deputies discussed the draft Law on Cyber Security (ANM); 70 delegates gave comments in groups (October 31, 2025), 15 delegates gave comments in the Hall (November 6, 2025) and 5 National Assembly delegations sent their opinions in writing.
