Minister of Home Affairs Pham Thi Thanh Tra has just signed and issued Official Letter 14/CV-BCD in 2025 of the Steering Committee for the arrangement of administrative units at all levels and building a model of organizing local government at 2 levels of the Government, guiding the resolution of difficulties and problems in operating the model of organizing local government at 2 levels.
According to the Steering Committee, one of the current issues is the inconsistency in legal regulations on the authority to establish a Public Administration Service Center in the Law on Organization of Local Government 2025 and Decree No. 118/2025/ND-CP of the Government on implementing one-stop, one-stop interconnection administrative procedures at the one-stop department and the national public service gate.
Therefore, the Steering Committee assigned the Ministry of Home Affairs to preside over and coordinate with relevant ministries and branches to provide specific and clear guidance on the authority to decide on the establishment of the Public Administration Service Center for localities to apply consistently.
At the same time, the Ministry of Home Affairs is also assigned the task of developing and submitting to the Government for promulgation a Decree amending and supplementing regulations on the establishment, reorganization, and dissolution of public service units (including public service units under commune-level People's Committees).
Develop and submit to competent authorities to issue legal documents related to the implementation of the organization of local government at 2 levels.
These include: Standards for administrative units and classification of administrative units; criteria, conditions, and procedures for recognizing island communes, safe zone communes, and safe zone areas; organization and operation of villages and residential groups; regulations on the procedures for establishing and managing administrative unit boundary records.
Along with that are solutions to increase the team of qualified and professional human resources for the commune level; implement reasonable incentive policies to attract and retain good cadres to work at the grassroots level.
Regarding finance, the Ministry of Finance shall preside over and coordinate with relevant ministries and branches to provide specific guidance and perfect legal mechanisms and policies on the missing unit price norms and standards, which are not suitable for practice.
Review and propose amendments and supplements to laws related to the assignment of tasks for placing orders, bidding for public services, and procurement of public services.
The document also clearly stated that the Ministry of Finance promptly guides the resolution and removal of difficulties and obstacles according to its authority for local recommendations on working headquarters and means of service for cadres, civil servants and public employees after the reorganization.
Previously, according to the Government's instructions, for the education sector: Maintain public secondary schools, primary schools, and kindergartens and transfer them to local authorities at the commune level for management.
For vocational education centers, continuing education centers under the district-level People's Committee will now be transferred to the Department of Education and Training for management and reorganization to provide services in inter-commune and ward areas.
For the health sector: Maintain existing commune and ward health stations to meet the health care needs of local people. Based on the area and population of the new commune-level administrative unit, the provincial People's Committee can reorganize into a public service unit under the commune-level People's Committee to carry out the task of disease prevention and primary health care for local people.
