Will minimize the time to issue construction permits

Deputy Minister Bui Xuan Dung said that the maximum time to issue a construction permit will be reduced (the maximum permit issuance period is expected to be 7 - 10 days).

On November 24, the National Assembly Standing Committee gave its opinion on the explanation, acceptance, and revision of the draft Law on Construction (amended).

Presenting the Report on receiving and revising the draft Law on Construction (amended), Deputy Minister of Construction Bui Xuan Dung said that the draft law has focused on cutting and simplifying procedures, shortening the time to prepare for construction investment, and promoting socio-economic development.

Previously discussed, some opinions said that the expansion of subjects exempted from construction permits should be strengthened with post-inspection and inspection, handling of violations. Or if the project has a full detailed planning at a scale of 1/500, the construction permit (GPXD) will be exempted.

There are also opinions that GPXD exemption should not be expanded, due to concerns about difficulties in determining ownership of assets on land and not being able to control safety.

Accepting these opinions, the Government said that, implementing the principle "from preparation to construction, each project must only carry out one administrative procedure".

The regulations on GPXD exemption have included projects with detailed plans 1/500 after being controlled by competent authorities on basic contents of planning compliance and safety.

The draft law also adds the content of construction order management in Article 47 to ensure management requirements when partly changing from "pre-inspection" to "post-inspection".

The management of construction order is carried out from the start of construction to acceptance and handover, in order to detect, prevent and handle violations.

Regarding works exempted from GPXD, the Deputy Minister of Construction said that the legal regulations on land have stipulated the determination of assets attached to land.

In response to the opinions of the delegates, the Ministry of Construction coordinated with the Ministry of Agriculture and Environment in the process of developing documents under the law to avoid missing the subjects.

In particular, the draft law shortens administrative procedures in the direction that licensing procedures will be regulated in the decree in the direction of implementing the entire process online; simplifying records and conditions.

The Deputy Minister of Construction said that the maximum time to issue a GPXD will be reduced (the maximum time to issue a construction permit is expected to be 7 - 10 days). These regulations will reduce at least 30% of time and costs as required by the Government.

Presenting the inspection report, Chairman of the Committee for Science, Technology and Environment Nguyen Thanh Hai said that expanding the case of GPXD exemption and ownership of houses has attracted much attention from delegates.

According to the Land Law, the dossier for granting an ownership certificate for a house requires a household registration.

"If the license is exempted, will there be a notice of commencement or a design appraisal document with value equivalent to the construction permit, when carrying out procedures to issue an ownership certificate to ensure the rights of the people?" - The Chairman of the Committee for Science, Technology and Environment asked and said "very worried about this".

"It's fun to be exempted from a license, but the proposal to exempt GPXD must closely coordinate with the Land Law. Exemption from GPXD and issuance of red books have a close relationship with each other and the people, so it needs to be carefully considered" - Ms. Nguyen Thanh Hai said.

The Chairman of the Committee for Science, Technology and Environment also said that there are still about 3,000 real estate projects in difficulty. From there, he suggested that the drafting agency carefully review the transition regulations to unlock resources.
