Commenting on the draft Law amending and supplementing a number of articles of the Penal Code, many National Assembly deputies expressed their interest in adding the crime of illegal use of drugs to the draft law.
According to delegate Nguyen Hai Dung (Nam Dinh delegation), from the perspective of drug consumption in the supply-demand relationship, the use of drugs, that is, "merely" will stimulate "merely".
Therefore, it is necessary to reduce the "demand" by reducing users or reducing the level of use of that person.
The delegate also said that the National Assembly has approved the National Target Program on Drug Prevention and Control until 2030. Therefore, reducing "demand" is also one of the purposes of this program.
According to the delegate, we cannot criminally reduce the "use" of drugs. Regarding drug use, the user is a patient and must be cared for and recovered.
Previously, the Penal Code had classified illegal use of drugs as a crime. The law later removed this crime, considering drug users as patients.
"The problem of drug use is still urgent, but we have a National Target Program. I think it is not necessary to re-criminalise again, so I do not agree to add the crime of illegal use of drugs to the law this time," delegate Nguyen Hai Dung emphasized.
Sharing the same view, delegate Khuong Thi Mai (Nam Dinh delegation), a drug addict, is considered a patient, and drug rehabilitation is carried out at a drug rehabilitation facility or at home or in the community. Therefore, it is necessary to carefully study the crime of illegal use of drugs in the draft law.
Meanwhile, delegate Ma Thi Thuy (Tuyen Quang delegation) said that there should be more strict policies to reduce the drug " cau". Currently, many synthetic drugs cause great consequences for society.
The delegate emphasized that with a large number of drug addicts, adding this crime to the law is appropriate to deter and contribute to reducing crime.
Delegate Nguyen Thi Yen Nhi (Ben Tre Delegation) said that this regulation comes from the practical work of fighting, preventing and handling illegal drug use. The situation of drug use is increasingly complicated and greatly affects the health of the current generation, affecting security, order and social safety.
Therefore, the delegate expressed their agreement with the regulation to add the crime of illegal use of drugs in the draft.

Similarly, delegate Nguyen Thi Thu Ha (Quang Ninh delegation) also expressed her agreement with the draft Law on Supplementing the crime of illegal use of drugs.
However, the delegate was concerned that this would put great pressure on detention facilities for crimes ranging from 2-3 years of first violation and 3-5 years for repeat violations.
The delegate suggested that it is necessary to study and consider ensuring criminal detention conditions for this content, thereby facilitating the implementation process.
