The Government has issued Decree No. 170/2025 on recruitment, use and management of civil servants, effective from July 1, 2025.
Notably, the Decree has abolished relevant regulations on commune-level civil servants in Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government.
Accordingly, regulations related to part-time workers at the commune level, in villages and residential groups will remain the same until new regulations are issued.
According to Clauses 6, 7 and 8, Article 33 of Decree 33/2023/ND-CP, the number of non-professional workers in villages and residential groups is regulated as follows:
Part-time workers in villages and residential groups with no more than 3 positions (including Party cell secretary, village chief or residential group leader, head of the Front Working Committee) are entitled to monthly allowances. In case the law has other provisions, it shall be implemented according to the provisions of that law.
Encourage the concurrent holding of the position of Party Cell Secretary as both Village Head, Head of Residential Group or Head of the Village Front Working Committee, Residential Group.
People directly participating in activities in villages and residential groups in addition to the 3 positions specified in Clause 6, Article 33 of Decree 33/2023/ND-CP are entitled to receive monthly support.
Non-professional workers at the commune level, in villages and residential groups are allowed to concurrently work with other non-professional workers at the commune level, in villages and residential groups; non-professional workers in villages and residential groups are allowed to concurrently work directly with activities in villages and residential groups.
According to Decision 1589/QD-TTg on the plan to implement the Law on Organization of Local Government, the Ministry of Home Affairs is assigned to preside over and coordinate with the Ministry of Justice, the Government Office and relevant agencies and organizations to develop many legal documents.
In particular, the Ministry of Home Affairs will advise the Government to issue a Decree on the organization of activities of villages and residential groups and a number of regimes and policies for part-time workers in villages and residential groups. This task is required to be completed in November 2025.
Along with that, the Ministry of Home Affairs coordinates to advise and develop a Resolution of the National Assembly Standing Committee on administrative unit standards, to be completed in September 2025; a Government Decree regulating the framework for the number of Vice Chairmen of the People's Committee; the number and structure of People's Committee members; procedures for proposing to approve the results of the People's Council for electing, dismissing, and removing Chairmen and Vice Chairmen of the People's Committee; procedures for transferring, removing from the positions of Chairman and Vice Chairman of the People's Committee, and assigning the authority to the Chairman of the People's Committee, to be completed in August 2025.
