On the afternoon of November 23, on Vietnam Cultural Heritage Day, with the majority of delegates in favor, the National Assembly passed the Law on Cultural Heritage (amended).
One of the new points of the Law on Cultural Heritage (amended) is that, from July 1, 2025 (when the law comes into effect), a cultural heritage inspectorate will be established.
Article 92 of the newly passed law stipulates this content as follows: The cultural heritage inspection agency is established at the advisory agency, assisting the state management of cultural heritage at the central level to perform the task of specialized inspection of cultural heritage, perform the task of receiving citizens, resolving complaints and denunciations, and preventing and combating corruption and negativity in the field of cultural heritage according to the provisions of law; the Government shall detail this Article.
Before the National Assembly voted to pass the Law, Chairman of the Committee on Culture and Education Nguyen Dac Vinh presented a report explaining, accepting and revising the draft Law on Cultural Heritage (amended).
Mr. Nguyen Dac Vinh said that some opinions agreed with the provisions on specialized inspection of cultural heritage in the draft Law. Some opinions suggested considering this provision.
According to Mr. Nguyen Dac Vinh, after the 7th Session, the National Assembly Standing Committee directed the review and sent a document requesting the Government to comment and propose a plan on the necessity of establishing a cultural heritage inspectorate in the draft Law or regulations in the Decree on the agency performing the specialized inspection function, if a specialized inspectorate for cultural heritage is established.
"The Government has carefully considered and agreed to propose regulations on specialized inspection of cultural heritage in the draft Law, because state management of cultural heritage is a large, complex, and important field," said the Chairman of the Committee for Culture and Education.
According to Mr. Nguyen Dac Vinh, the Standing Committee of the National Assembly, cultural heritage in our country is very diverse in type, nature, value, and scale, so it is necessary to have a team of inspectors with specialized expertise and skills to ensure effective implementation of prevention, timely detection, prevention, and handling of violations in the field of cultural heritage.
The Law on Cultural Heritage (amended) has just been passed, consisting of 9 chapters and 95 articles, closely following the major goals, viewpoints and policies approved by the National Assembly, institutionalizing the Party's policies, overcoming shortcomings and limitations in the implementation of the Law on Cultural Heritage, improving the effectiveness and efficiency of management, protection and promotion of cultural heritage values.
Compared with the current Law, the draft Law has basic new points, including: Perfecting regulations on prohibited acts to ensure more accuracy and completeness, serving as a basis for guiding implementation, inspection, and handling of violations in protecting and promoting the value of cultural heritage;
Specific regulations on repair, renovation, construction of works, individual houses inside and outside the relic protection area; regulations on management of relics, antiquities, national treasures, handling of discovered and handed over relics, antiquities; supplementing the Cultural Heritage Conservation Fund...
