The Government has just issued Decree No. 367/2025/ND-CP amending and supplementing a number of articles of Decree No. 118/2025/ND-CP dated June 9, 2025 on implementing administrative procedures according to the one-stop shop mechanism, inter-agency one-stop shop at the one-stop shop department and the National Public Service Portal.
Regarding regulations on people working at the Provincial-level Public Administration Service Center, Decree 367/2025/ND-CP amends: Leaders of the Provincial-level Public Administration Service Center are appointed by the Chairman of the Provincial People's Committee, including 1 Director equivalent to the Deputy Chief of the Provincial People's Committee Office or concurrently appointed by the Deputy Chief of the Provincial People's Committee Office.
The Center shall not exceed 3 Deputy Directors equivalent to Heads of Departments under the Provincial People's Committee Office to assist the Director of the Center in performing one or more specific tasks assigned by the Director of the Center and be responsible to the Director of the Center and before the law for performing assigned tasks.
At the same time, Decree 367/2025/ND-CP supplements regulations: Provincial People's Committees stipulate the establishment of departments under the Provincial Public Administration Service Center, ensuring compliance with the criteria for establishing departments under sub-departments under departments in accordance with the law.
For the One-Level Public Administration Service Center directly under the Provincial People's Committee, the Center's leadership includes 1 Director equivalent to the Director of the Department.
Deputy Directors equivalent to Deputy Directors of Departments are appointed by the Chairman of the Provincial People's Committee, assisting the Director of the Center in performing one or more specific tasks assigned by the Director of the Center and are responsible to the Director of the Center and before the law for performing assigned tasks.
The number of Deputy Directors is implemented according to the Government's regulations on the number of deputy heads of specialized agencies under the Provincial People's Committee.
Provincial People's Committees stipulate the specific functions, tasks, powers and organizational structure of the Public Administration Service Center at one level.
Leaders of the Commune-level Public Administration Service Center include a Director equivalent to the Head of Department; Deputy Director equivalent to the Deputy Head of Department under the Commune-level People's Committee to assist the Director in performing one or more specific tasks assigned by the Director and be responsible to the Director and before the law for performing assigned tasks.
The number of Deputy Directors is implemented according to the Government's regulations.
Previously, according to Resolution No. 332/NQ-CP, professional and equivalent departments, the Public Administration Service Center under the People's Committees of communes, wards, and special zones were arranged with an average of 2 deputy heads; in which, the leaders of the Public Administration Service Center at the commune level include the Director (Vice Chairman of the People's Committee at the commune level who does not concurrently hold the position of Director of the Public Administration Service Center at the commune level) and the Deputy Director equivalent to the Deputy Head of Department under the People's Committee at the commune level.
Commune-level People's Committees shall specifically decide the number of deputy heads of professional departments and equivalents, Public Administration Service Centers under their management, ensuring that they do not exceed the total number of deputy heads according to the decisions of competent authorities.
