The crime of transporting and selling drugs as twins
Continuing the 9th Session, on the morning of May 27, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Penal Code.
With 8 crimes proposed to remove the death penalty, delegate Pham Van Hoa (Dong Thap Delegation) agreed to remove 6 crimes, leaving 2 crimes (Embezzlement, corruption; illegal transportation of drugs).
Expressing his opinion, the delegate said that up to now, no one has been sentenced to death for embezzlement or corruption. Recently, there have also been cases where the Procuracy proposed the death penalty for a number of subjects in the case that occurred at Van Thinh Phat Group, SCB Bank and related units and organizations.
According to the delegate, when the Procuracy proposed to death, the families of the defendants disagree. But when the court declared death, a few days later the family brought money to overcome the consequences of the case, like "atoning the death penalty".
"The death penalty for these crimes is for prevention, deterrence, and warning. In particular, with corruption, the policy of our Party and State is to properly punish these subjects," the delegate said and suggested re-studying these crimes.
The delegate continued to cited Ms. Truong My Lan causing damage and budget losses of millions of billions of VND. This is such a large number that it is unimaginable that if we only overcome this half, we will have built 50% of the North - South high-speed railway line. Therefore, the death penalty for this crime should be kept the same.
Regarding the crime of illegally transporting drugs, the delegate said that this crime is the crime of illegally buying, selling and storing drugs like twins, only born first and born later. Because if there is no illegal transportation of drugs, why would there be people using them?
From the above analysis, the delegate suggested maintaining the penalty framework for the crime of illegally transporting drugs.
The delegate also agreed with not carrying out the death sentence for people with terminal cancer and HIV. In addition, it is recommended to add end-stage kidney failure, severe liver disease that cannot be treated. "Abusing the death penalty is also a humane policy of our Party and State," the delegate emphasized.
Must be sentenced to prison for drug use
Regarding the crime of illegal use of drugs, delegate Pham Van Hoa said that the lack of criminal handling has caused many complaints from people and voters. Many subjects illegally use drugs, causing especially serious dangers to society.
"If you see drug addicts as sick people and spend money to treat them in reform houses, but when they are in the camp, the repair rate is not much. Therefore, to prevent deterrence, we must punish them with imprisonment for drug use," the delegate stated.

Sharing the same view, delegate Phan Thi My Dung (Long An delegation) said that many voters proposed that the law should do what to handle drug addicts. Currently, drug addicts are only subject to administrative measures, and are sent to compulsory drug rehabilitation facilities for both drug rehabilitation and treatment.
According to the delegate, the preventive and deterrent effects of this penalty are not high. Addicts are currently getting younger, the number of addicts is very large, the rate of drug addiction withdrawal and relapse is also very high.
Therefore, the delegate said that handling administrative violations for drug addicts is difficult. Therefore, the legalization of this crime is appropriate and has basis for practice and it is recommended that there be a roadmap for implementation.
