Mr. Quang (Quang Ngai) questioned the regulations and administrative procedures for handling the Chairman of the Commune Veterans Association for having a third child.
Regarding Mr. Quang's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Disciplinary action against commune-level officials (including the Chairman of the Commune Veterans Association) who have a third child has been specifically regulated in the Government's Decrees:
Article 29 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government on commune-level cadres, civil servants, and part-time workers at the commune level, in villages and residential groups stipulates: Discipline for commune-level cadres and civil servants shall be implemented in accordance with the Government's regulations on disciplinary action against cadres, civil servants and public employees.
In case the law, the Party Charter, or the socio-political organization have other provisions, the provisions of such law and charter shall apply;
Clause 9, Article 8 of Decree 112/2020/ND-CP dated September 18, 2020 of the Government (amended and supplemented in Decree 71/2023/ND-CP) on disciplinary action against cadres, civil servants and public employees stipulates the disciplinary form of "reprimand" for cadres "violating the provisions of the law on prevention and control of domestic violence; population, marriage and family; gender equality, social security; other provisions of the Party and of the law related to cadres and civil servants".
At the same time, Articles 20 and 21 of this Decree also stipulate the authority, order and procedures for disciplinary action against officials.
