The amounts G, H, I, K, L, Clause 1 and Clause 2, Clause 3, Article 5, Decree 20/22021/ND-CP stipulating that children under 16 years of age have no source of nurturing in one of the following cases that are entitled to monthly social benefits:
g) Both father and mother are receiving care and support at social assistance facilities and social housing;
h) Both father and mother are serving prison sentences in prison or are serving decisions on handling administrative violations at reform schools, compulsory education institutions, and compulsory drug rehabilitation facilities;
i) Father or mother declared missing according to the provisions of law and the remaining person is receiving care and fostering at social assistance facilities or social housing;
k) Father or mother declared missing according to the provisions of law and the other person is serving a prison sentence or is serving a decision to handle an administrative violation at a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility;
l) Father or mother who is receiving care and fostering at a social assistance facility and the other person who is serving a prison sentence in prison or is serving a decision to handle administrative violations at a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility.
2. People under the provisions of Clause 1 of this Article are entitled to monthly social allowances but are 16 years old but are studying culture, vocational training, professional secondary school, college, first degree university, they continue to enjoy social assistance policies until the end of school, but not more than 22 years old.
3. Children infected with HIV/AIDS belonging to poor households.
Thus, children of the above subjects are entitled to monthly social allowances.
