Office of Legal Consulting of Lao Dong Newspaper replied:

Clause 15, Article 1 of Decree 114/2024/ND-CP (effective from October 30, 2024) amends and supplements a number of articles of Decree 151/2017/ND-CP detailing a number of articles of the Law on Management and Use of Public Assets, stipulating the amendment of Article 23 on the dossier of proposal to sell public assets, including:

a) Document requesting the sale of public assets by the agency assigned to manage and use public assets (clearly stating the form of organization of asset sale, management and use of proceeds from asset sale): 01 original;

b) Document requesting the sale of public assets from the superior management agency (if any): 01 original;

c) List of assets proposed for sale (type, quantity, area; condition; original price, remaining value according to accounting books; current purpose of use; reason for sale): 01 original;

d) Opinion of the People's Committee of the province where the office is located (in case of selling the office), including the opinion on the planning of the land area: 01 copy;

d) Other documents related to the proposal to sell assets (if any): 01 copy.

In case of selling the office building, based on the actual situation and the status of the property attached to the land, the state agency with the property shall report to the superior management agency (if any) to report to the agency or person with the authority to decide on the sale of the property for consideration and decision on the sale of the property attached to the land together with the land use right or the liquidation of the property attached to the land in the form of demolition or cancellation before organizing the sale of the office building in the document requesting the sale of public property.

Thus, the application for sale of public assets under the new law is regulated as above.
