Lao Dong Newspaper Legal Consulting Office replied:
Clause 5, Article 5 of Decree 20/2021/ND-CP stipulates that elderly people in one of the following cases are eligible for social protection and receive monthly social allowances:
a) Elderly people who are poor households and have no one with the obligation and right to support them, or have someone with the obligation and right to support them but this person is receiving monthly social allowance;
b) Elderly people from 75 to 80 years old, belonging to poor households or near-poor households not specified in Point a of this Clause, living in communes and villages in ethnic minority and mountainous areas with special difficulties;
c) People aged 80 years or older who are not subject to the provisions of Point a of this Clause and do not have a pension, monthly social insurance allowance, or monthly social allowance;
d) Elderly people from poor households, without anyone with the obligation and right to support them, without conditions to live in the community, eligible for admission to social assistance facilities but have someone to raise and care for them in the community.
Point d, Clause 1, Article 6 of Decree 20/2021/ND-CP stipulates the monthly social allowance level for the elderly as follows:
- Coefficient 1.5 for subjects specified in Point a, Clause 5 from 60 years old to 80 years old;
- Coefficient 2.0 for subjects specified in Point a, Clause 5 from 80 years old and above;
- Coefficient 1.0 for subjects specified in points b and c, clause 5;
- Coefficient 3.0 for subjects specified in point d, clause 5.
Article 1, Decree 76/2024/ND-CP stipulates that the standard level of social assistance applied from July 1, 2024 is VND 500,000/month.
Thus, the highest social allowance for the elderly is 3 x 500,000 VND/month = 1.5 million VND/month.
