Clause 2, Article 3 of the 2010 Law on Persons with Disabilities stipulates the types and degrees of disabilities as follows:
2. Persons with disabilities are classified according to the following degrees of disability:
a) Persons with particularly severe disabilities are those who, due to their disabilities, cannot perform daily personal activities by themselves;
b) Persons with severe disabilities are those who, due to their disabilities, cannot perform some daily personal activities by themselves;
c) Persons with mild disabilities are those who do not fall under the cases specified at points a and b of this clause.
Clause 1, Article 44 of the 2010 Law on Persons with Disabilities stipulates social allowances and monthly care support as follows:
1. Subjects eligible for monthly social allowances include:
a) Persons with particularly severe disabilities, except for the cases specified in Article 45 of this Law;
b) Persons with severe disabilities.
Article 45 of the 2010 Law on Persons with Disabilities stipulates the care of persons with disabilities in social protection establishments as follows:
1. Persons with particularly severe disabilities who are homeless and cannot take care of themselves are admitted to social protection establishments for care.
2. The State provides funding for the care of persons with disabilities specified in Clause 1 of this Article to social protection establishments, including:
a) Monthly care allowances;
b) Purchase of personal items and daily necessities;
c) Purchase of health insurance cards;
d) Purchase of common medicines;
đ) Purchase of tools and means to support functional rehabilitation;
e) Funeral expenses upon death;
g) Monthly personal hygiene for female persons with disabilities.
3. The Government stipulates the levels of monthly care allowances and funding specified in Clause 2 of this Article.
Thus, persons with severe and particularly severe disabilities are entitled to monthly social allowances according to the above regulations. Persons with particularly severe disabilities who are homeless and cannot take care of themselves are admitted to social protection establishments for care.
