The Lao Dong Newspaper Legal Consulting Office replied:
Decree 178/2024/ND-CP stipulates policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the reorganization of the apparatus of the political system and Decree 67/2025/ND-CP on amending and supplementing a number of articles of Decree No. 178/2024/ND-CP, not regulating the one-time social insurance regime and the time to receive one-time social insurance.
According to current regulations, the current one-time social insurance payment is as follows:
- Employees who are old enough to receive pensions according to regulations but have not paid social insurance for 20 years;
Or female workers who are full-time or part-time workers in communes, wards and towns participating in social insurance who are old enough to receive pension according to regulations but have not paid social insurance for 15 years and do not continue to participate in voluntary social insurance.
- After a year of quitting a job but not having paid social insurance for 20 years and not continuing to participate in social insurance;
- Go abroad to settle down;
- People who are suffering from one of the life-threatening diseases such as cancer, paralysis, impetigo, leprosy, severe tuberculosis, HIV infection have passed the AIDS stage and other diseases as prescribed by the Ministry of Health;
- Employees in one of the following cases who are demobilized, discharged, or quit their jobs without being eligible for pension:
+ Officers and professional soldiers of the People's Army; officers, professional non-commissioned officers, officers and technical non-commissioned officers of the People's Public Security; people working in secret services receive the same salary as soldiers;
+ non-commissioned officers and soldiers of the People's Army; non-commissioned officers and soldiers of the People's Public Security for limited service; military, police and cryptography students currently studying are entitled to living expenses.
Thus, a person who quits his/her job according to the provisions of Decree 178/2024/ND-CP must still meet the above conditions when receiving one-time social insurance.
