The Lao Dong Newspaper Legal Consulting Office replied:
Article 23 of Decree 33/2023/ND-CP stipulates the transfer, work transfer and reception of commune-level civil servants from one commune, ward or town to work in another commune, ward or town as follows:
1. For civil servants of the Office - statistics, Land Administration - construction - urban and environment (for wards and towns) or Land Administration - agriculture - construction and environment (for communes), Finance - accounting, Justice - civil status, Culture - society:
a) The Chairman of the District People's Committee decides on the transfer of commune-level civil servants from one commune, ward or town to work in another commune, ward or town in the same district-level administrative unit;
b) The Chairman of the District People's Committee decides to transfer work and receive commune-level civil servants from communes, wards and towns of this district to work in communes, wards and towns of other districts after receiving a written consensus from the Director of the Department of Home Affairs;
c) The president of the district -level People's Committee decides to transfer the work to commune -level civil servants to the province and receive commune -level civil servants from other provinces after obtaining a written agreement of the Director of the Department of Home Affairs where the transfer and the receiving place.
2. For civil servants who are Commanders of the Commune-level Military Command:
The mobilization, transfer of work and reception of civil servants commander of the commune -level military command committee shall be carried out according to specific task requirements. The president of the district -level People's Committee shall decide the mobilization, transfer of work and receipt of civil servants commanding the head of the commune military command according to the local civil servant management decentralization.
3. Commune-level cadres and civil servants who are mobilized, transferred to work, or accepted to work at the commune level with particularly difficult socio-economic conditions are entitled to preferential regimes and policies according to the provisions of law.
Thus, the transfer and transfer of commune-level civil servants from one commune or ward to another commune or ward is regulated as above.
