The Lao Dong Newspaper Legal Consulting Office replied:
Article 43 of the Law on Social Insurance 2024 (effective from July 1, 2025) stipulates the period of sick leave as follows:
1. The maximum period of sick leave in one year (from January 1 to December 31) for subjects specified in Points a, b, c, i, k, l, m and n, Clause 1 and Clause 2, Article 2 of this Law is calculated according to working days not including holidays, Tet, weekly days off and is stipulated as follows:
a) Working under normal conditions is entitled to 30 days if having paid compulsory social insurance for less than 15 years; 40 days if having paid for 15 years to less than 30 years; 60 days if having paid for 30 years or more;
b) Doing a heavy, toxic, dangerous or especially heavy, toxic, dangerous job or occupation on the list of heavy, toxic, dangerous or especially heavy, toxic, dangerous jobs issued by the Minister of Labor, War Invalids and Social Affairs or working in an area with particularly difficult socio-economic conditions shall enjoy 40 days if paid compulsory social insurance for less than 15 years; 50 days if paid for 15 years to less than 30 years; 70 days if paid for 30 years or more.
2. After the sick leave period prescribed in Clause 1 of this Article but continue to receive treatment, employees who quit their jobs due to a disease on the list of diseases requiring long-term treatment issued by the Minister of Health will continue to receive sick leave at the level prescribed in Clause 3, Article 45 of this Law. The sick leave period prescribed in this clause is calculated according to working days not including holidays, Tet, and weekly days off.
3. The period of enjoying sick leave for subjects specified in Point d, Clause 1, Article 2 of this Law is based on the period of inpatient treatment at medical examination and treatment facilities and the period of time that employees have to take a leave of absence according to the prescription of the medical examination and treatment practitioner at the medical examination and treatment facility.
Thus, from July 2025, the sick leave period is regulated as above.
