Clause 6, Article 16 of the 2024 Trade Union Law (amended), effective from July 1, 2025, stipulates that when performing supervisory activities, the Trade Union has the following rights and responsibilities:

a) Develop a monitoring program and plan including content, form, subjects, time and other necessary contents to ensure monitoring implementation;

b) Notify in advance about the monitoring program and plan and request relevant employers, agencies and organizations to report in writing or provide information and documents related to the monitoring content;

c) Request employers, agencies and organizations being supervised to discuss and clarify necessary issues through supervision;

d) Recommend employers, supervised agencies, organizations or competent persons to consider applying measures to protect the legitimate rights and interests of employees, agencies, organizations, individuals and the interests of the State;

d) Propose to consider the responsibility of employers, supervised agencies, organizations, and individuals whose violations of the law are discovered through supervision;

e) Notify the monitoring results to the employer, the monitored agency, organization and relevant agencies, organizations and individuals;

g) Be responsible for the contents of recommendations after supervision; monitor and urge the resolution of recommendations after supervision; consider and resolve when there are recommendations on supervision results.

Thus, when presiding over the supervision of the union, it has the above rights and responsibilities.
