Responsibility of the Ministry of Public Security for the Road Traffic Accident Damage Reduction Fund

The Lao Dong Newspaper Legal Consulting Office replied:

Clause 1, Article 13, Decree 279/2025/ND-CP (effective from December 15, 2025) stipulates as follows:

1. Ministry of Public Security:

a) Responsible for managing, operating, using and paying and settling the Road Traffic Damage Reduction Fund in accordance with the provisions of law.

The unit advises the Minister of Public Security to monitor, manage, use and pay, and settle the Fund according to the provisions of this Decree and other relevant legal provisions, and is authorized to open an account at the State Treasury (where the unit is headquartered) and at commercial banks operating legally in Vietnam to manage and open accounting books to track revenues and expenditures, and prepare a settlement report for the Fund. Every year, financial planning is prepared, including: operation plan, revenue plan, financial expenditure plan submitted to the Minister of Public Security for decision; financial report preparation, settlement report according to the provisions of the law on finance and accounting. Carry out accounting, accounting, asset management, and use, independently audit financial statements according to the provisions of law and the instructions of the Ministry of Finance on accounting regimes. Implement the disclosure of the Fund's finances, operating regulations, and operational results in accordance with the provisions of this Decree and other relevant legal provisions.

b) Organize the mobilization and receipt of support, aid, and voluntary contributions from domestic and foreign organizations and individuals to the Fund.

c) Synthesize and evaluate the effectiveness of management and use of the Fund periodically every 6 months, annually and suddenly report to the Prime Minister, and send it to the Ministry of Finance for monitoring and general collection.

d) Regulations on instructions on the order and procedures for implementing the expenditure content from the Road Traffic Damage Reduction Fund.

Thus, from December 15, 2025, the Ministry of Public Security has the above responsibility to the Road Traffic Accident Damage Reduction Fund.
