The Lao Dong Newspaper Legal Consulting Office replied:
Article 13 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level stipulates that Vietnamese citizens who wish and meet the following standards and conditions are considered and selected to join this force:
1. From 18 years old to 70 years old; in cases where they are over 70 years old and ensure their health, the Chairman of the Commune-level Human Resources Committee shall consider and decide based on the proposal of the Commune-level Police;
2. Having a clear background; good moral qualities; self and family complying with the Party's guidelines and policies, the State's policies and laws; not being a person being prosecuted for criminal liability, serving a criminal sentence in a commune, ward, or town, serving judicial measures or serving administrative handling measures. In case the Court's verdict has been enforced, the record must be erased; if the decision to apply administrative measures has been enforced, the deadline must expire and the administrative measures must not be applied according to the provisions of law;
3. Have a graduation certificate or have completed a secondary school education program or higher. For border areas, islands, mountainous areas, areas with particularly difficult socio-economic conditions, and ethnic minority areas, it is possible to select people who have completed the primary education program;
4. Having been a permanent or temporary resident for 1 year or more and regularly living at the place where the citizen submitted an application to join the force to participate in protecting security and order at the grassroots level. In the case specified in Clause 3, Article 15 of this Law, they must be permanent or temporary residents at the place of application for participation in the force participating in protecting security and order at the grassroots level;
5. Have enough health according to the certificate of the established medical examination and treatment facility, operating according to the provisions of law.
Clause 1, Article 4, Circular 14/2024/TT-BCA stipulates: Within 5 working days from the date of making the Minutes of the recruitment results, the Commune-level Police shall have a document accompanying the following documents reporting to the Chairman of the People's Committee at the same level to issue a decision to establish a Security and Order Protection Team, deciding to recognize the Team Leader, Deputy Team Leader, and Team Member of the Security and Order Protection Team: Minutes of recruitment results of the Security and Order Protection Team; list of requests for recognition as a Member of the Security and Order Protection Team (Form No. 05 Appendix to this Circular); list of recommendations for recognition as a Team Leader, Deputy Team Leader of the Security and Order Protection Team (Form No. 06 Appendix to this Circular).
Thus, for people over 70 years old who are in good health, the Chairman of the Commune-level Humanitarian Committee shall consider and decide to join the force to participate in protecting security and order at the grassroots level based on the proposal of the Commune-level Police. The selection of who to be the Head of the Security and Order Protection Team is considered and decided by the Chairman of the People's Committee of the commune.
