Ministry of Public Security withdraws proposal to reduce fines for alcohol violations

The Ministry of Public Security proposes to maintain the lowest alcohol concentration fines for drivers of motorbikes and special-purpose motorbikes.

The draft Decree on administrative sanctions for violations of traffic order and safety (TTATGT) in the field of road traffic; deduction of points and restoration of driving license points, drafted by the Ministry of Public Security, is being reviewed by the Ministry of Justice.

In this third draft, the alcohol concentration violation thresholds continue to be determined as per current regulations. Accordingly, the lowest level is not exceeding 50mg/100ml of blood or 0.25mg/liter of breath; exceeding 50mg to 80mg/100ml of blood or exceeding 0.25mg to 0.4mg/liter of breath; the highest level is exceeding 80mg/100ml of blood or exceeding 0.4mg/liter of breath.

Notably, in the latest published draft, the Ministry of Public Security withdrew the proposal to lower the fine level compared to Decree No. 100/2019 (amended and supplemented in Decree 123/2021) for violations of alcohol concentration not exceeding 50mg/100ml of blood or not exceeding 0.25mg/1 liter of breath.

Accordingly, the Ministry of Public Security proposed a fine of 6 to 8 million VND for drivers of cars and similar vehicles, four-wheeled motorized passenger vehicles, and four-wheeled motorized cargo vehicles whose blood or breath alcohol concentration does not exceed 50 mg/100 ml of blood, or does not exceed 0.25 mg/1 liter of breath. At the same time, 3 points will be deducted from the driver's license.

This level is similar to the provisions in Decree 100 (amended and supplemented in Decree 123) currently in force.

Previously, in the draft in August, the Ministry of Public Security proposed reducing the fine to from VND800,000 to VND1 million for driving a vehicle with a blood or breath alcohol concentration not exceeding 50mg/100ml of blood, or not exceeding 0.25mg/1 liter of breath.

The new draft also maintains the current fine of 16 - 18 million VND for driving on the road with a blood or breath alcohol concentration exceeding 50mg to 80mg/100ml of blood, or exceeding 0.25mg to 0.4mg/1 liter of breath. The driver will also have 10 points deducted from his/her driving license.

The fine is 30 - 40 million VND for driving on the road with a blood or breath alcohol concentration exceeding 80 mg/100 ml of blood or exceeding 0.4 mg/1 liter of breath. The driver will also have all 12 points on his/her driving license deducted.

Proposal to maintain the lowest alcohol concentration fines for drivers of motorbikes and specialized motorbikes

For motorbikes and scooters, the latest draft also proposes a fine of 2-3 million VND for drivers of motorbikes, scooters, and similar vehicles on the road whose blood or breath alcohol concentration does not exceed 50 mg/100 ml of blood, or does not exceed 0.25 mg/1 liter of breath. According to current regulations, the fine is from 2 to 3 million VND.

Previously, in the draft decree in August, the Ministry of Public Security proposed a fine of 400,000 VND - 600,000 VND.

The Ministry of Public Security also proposed in the latest draft to impose a fine of 3-5 million VND on drivers of specialized motorbikes on the road with alcohol concentration in blood or breath not exceeding 50 mg/100 ml of blood, or not exceeding 0.25 mg/1 liter of breath. Current regulations impose a fine of 3-5 million VND.

In the draft in August, the Ministry of Public Security proposed a fine of VND800,000 - VND1 million for drivers of specialized motorbikes.
