On April 23, the National Cyber Security Association held a seminar on "Contacting on the Draft Law on Personal Data Protection".
In his opening speech, Lieutenant General Nguyen Minh Chinh - Permanent Vice President of the National Cyber Security Association, Director of the Department of Cyber Security and High-Tech Crime Prevention, Ministry of Public Security - said that the situation of leaking, leaking, stealing, and trading personal information in cyberspace also occurs frequently. More and more entities collect, analyze, and process personal data for different purposes but do not notify customers or allow violations of personal data protection to occur.
Many new cyberspace services have appeared, with activities of collecting, exploiting, and analyzing information and personal data, but without a mechanism for managing user data, raising many issues related to national security, social order and safety, and harming the legitimate rights and interests of organizations and individuals.
These challenges pose an urgent need to develop and perfect the Law on Personal Data Protection to institutionalize the provisions of the Constitution and the law on the right to protect personal secrets, human rights, civil rights, and cyber security.
According to statistics, in the world, more than 140 countries issued legal documents on personal data protection, the closest to India, Thailand and Malaysia. "Vietnam also cannot slow down in the promulgation of the Law, the Ministry of Public Security urgently advised the Government to submit to the National Assembly of the Law on Protection of personal data for consideration and approval at the 9th session, the XV National Assembly in May 5," - Lieutenant General Nguyen Minh Chinh said.

Lieutenant General Nguyen Minh Chinh affirmed that the Law on Personal Data Protection is an important step forward in institutionalizing human rights and civil rights, in line with the orientation of "taking people as the center, goal and driving force" set forth in Resolution No. 27-NQ/TW of the Central Committee. The development of laws not only meets internal needs, but is also a requirement for international integration, ensuring national digital sovereignty.
At the seminar, the representative of the Drafting Board - Major Dao Duc Trieu, Deputy General Secretary of the Association, Head of Research, Policy and Law Advice presented the key contents in the draft, including: Scope of adjustment, principles of personal data processing, rights and obligations of entities, data protection responsibilities, violation processing mechanisms and assurance of privacy in digital environments. The presentation also clarifies the orientation to build the law in the spirit of continuing Decree No. 13/2023/ND-CP, but at a higher level, synchronous and basic.


Delegates also listened to in-depth presentations from representatives of organizations and enterprises, in which the Institute for Policy and Development Strategy Management made recommendations on perfecting the law on personal data protection from the perspective of international research and comparison; representatives of Viettel Group shared difficulties and proposed policies to support telecommunications enterprises in the process of implementing the Law; while VNDS Company presented practical experiences in complying with personal data protection requirements at technology enterprises.
In the context that Vietnam is entering the phase of speeding up digital transformation, the development of a specialized law on personal data protection is urgent. The draft Law on Personal Data Protection includes 7 chapters and 69 articles, fully stipulating the following contents: Principles of data processing, rights and obligations of related data subjects and parties, transfer data abroad, assess data impact, credit rating for data protection, violations and inspection and supervision mechanisms. The law also regulates foreign organizations and individuals that collect and process Vietnamese citizens data.
