"The Standing Committee of Nhon Phuc Commune People's Council has agreed with the proposal of the Provincial People's Procuracy," he said.
The leader of the Nhon Phuc Commune Party Committee added that Mr. Cuong violated the law by allowing illegal mineral exploitation to serve the North-South Expressway project through the area. The locality is waiting for the decision to prosecute the accused to have a basis for further handling of Mr. Cuong. Currently, Mr. Cuong continues to assume the duties of Chairman of the Commune People's Committee.
According to the announcement, the People's Procuracy of Binh Dinh province is handling the case of "Violation of regulations on resource exploitation" occurring in Nhon Phuc commune, prosecuted by the Investigation Security Agency of the provincial police.
The investigation process has sufficient basis to determine that Mr. Duong Thanh Cuong's behavior constitutes the crime of "Lack of responsibility causing serious consequences".
During the investigation, the two defendants N.D.S.V and N.D.D also confessed that during the illegal sand mining process, they gave money to Mr. Duong Dinh Cuong many times, showing signs of "Giving bribes" and "Receiving bribes".
According to the People's Procuracy of Binh Dinh province, because this is a complicated case, the crime occurred over a long period of time, so to clarify the case, it is necessary to prosecute the accused and apply preventive measures (temporary detention) to serve the investigation of the case.
However, Mr. Duong Thanh Cuong is a delegate of the People's Council of Nhon Phuc commune, so the Provincial People's Procuracy requested the Standing Committee of the People's Council of Nhon Phuc commune to respond in writing so that the prosecution agency can carry out the decisions to prosecute and temporarily detain Mr. Duong Thanh Cuong.
Informing the press, a representative of the Investigation Security Agency of Binh Dinh Province Police said that the unit is consolidating the case file and clarifying the actions of Mr. Duong Thanh Cuong, including the act of "Receiving bribes".
