Regarding the issue of land clearance for essential infrastructure projects to stabilize the lives of residents in Ward 8 and Phu Hung Commune, Ben Tre City, the old Ben Tre Province, Phase 2 (now this project is located in Phu Khuong Ward, Vinh Long Province), recently, the People's Committee of Phu Khuong Ward (Vinh Long Province) issued Decision No. 1812 on regulating other support policies when the State reclaims land to implement essential infrastructure projects to stabilize the lives of residents in Ward 8 and Phu Hung Commune, Ben Tre City, the old Ben Tre Province (hereinafter referred to as the D5 Road Project) Phase 2.
According to this Decision, the People's Committee of Phu Khuong Ward decides that for houses and construction works attached to land created on land that are not in accordance with the land use purpose when the State reclaims land, but the property was created before the site clearance pile was planted and before the competent authority issued a notice of land recovery for project implementation, from the time the property was created until the time the land was announced for project implementation was not blocked by the competent authority, administrative sanctions were imposed, and compensation must be paid for violations of land laws but other support is provided according to the provisions of Clause 2, Article 108 of the 2024 Land Law to ensure housing, stabilize life and production for people whose land is reclaimed and owners of property. The support level is 100% of the new construction value of houses and construction works with equivalent technical standards according to the provisions of the law on construction at the time of approving the compensation, support and resettlement plan.
Allocate residential land with land use fees for 7 households with houses built on agricultural land, houses with houses on other agricultural land that have been partially cleared and the rest cannot be repaired, have to relocate and have no other place to live in Ben Tre City (old) at the time of land acquisition, have permanent residence registration in the locality, and have a need for residential land.
In addition, support the cost of relocating the plastic bag manufacturing system, the cost of relocating the three-phase after-line power line, the cost of relocating the printing system to make a signboard of Mr. Nguyen Phong Phu. The support level is equal to the relocation and installation costs quoted by the service provider.
Up to now, the D5 road project phase 2 has cleared 62 households, while 24 households have not yet handed over the land. The main reason for the land clearance problem is that some households building houses and works on agricultural land request compensation for assets attached to the land before handing over the land.
According to the report of the Vinh Long Province Agricultural Project Management Board, up to now, the D5 road project phase 2 has a construction volume of about 70%.
The essential infrastructure project to stabilize the lives of residents in Ward 8 and Phu Hung Commune, Ben Tre City, the old Ben Tre Province, phase 2, affects 86 households. This project is invested by the Management Board of Investment Projects for Construction of Agricultural Works and Rural Development of Ben Tre Province (now the Management Board of Agricultural Projects of Vinh Long Province).
The project implementation location includes Ward 8 and Phu Hung Commune, Ben Tre City, the old Ben Tre Province (now Phu Khuong Ward, Vinh Long Province). The project has a starting point adjacent to Phu Hung roundabout (Nguyen Thi Dinh street and Huynh Tan Phat street), the end of the route connects to Nguyen Dinh Chieu street, with a length of more than 1.6 km, a road surface of 7.75 m wide. The total investment is more than 206.3 billion VND.
