Decree No. 140/2025/ND-CP of the Government stipulates the division of authority of local authorities at both levels in the field of state management of the Ministry of Construction. This Decree takes effect from July 1, 2025.
Article 25 of Decree 140/2025/ND-CP stipulates the tasks and authority in the aviation sector as follows:
The responsibility of coordinating with the Airport Authority in ensuring security and order, preventing terrorism and aviation emergencies is carried out by the People's Committee at the commune level.
The responsibility for coordinating the announcement and protection of boundaries and planning markers for airports and airports is carried out by the People's Committees at the commune level.

General principles
Ensure compliance with the provisions of the Constitution, in accordance with the principles and regulations on the division of authority, decentralization, and delegation of authority of the Law on Organization of the Government and the Law on Organization of Local Government.
Ensure the division of tasks and powers between local government levels in accordance with the tasks, powers and capabilities of the agencies and competent persons performing the assigned tasks and powers; do not overlap, overlap, or lack functions and tasks between local government at all levels and between agencies and organizations under local government.
Ensure a clear division of authority between the People's Council, People's Committee, Chairman of the People's Committee; clearly define the general authority of the People's Committee and the separate authority of the Chairman of the People's Committee.
Ensure a legal basis for the normal, continuous and smooth operation of agencies, society, people and businesses; ensure human rights and civil rights; create favorable conditions for individuals and organizations in accessing information, exercising rights, obligations and procedures according to the provisions of law.
Ensure unity in the organization of the implementation of the Constitution and the law; ensure publicity, transparency, accountability and effective implementation of power control associated with the responsibility of inspection, inspection and supervision of superior state agencies.
Ensure that it does not affect the implementation of international treaties and agreements to which the Socialist Republic of Vietnam is a member.
The resources for performing the task of deciding on authority are guaranteed by the state budget according to regulations.
In addition to general principles, the determination of authority in the field of state management of the Ministry of Construction must ensure the transfer of tasks and powers of the People's Council, People's Committee, Chairman of the District People's Committee in specialized laws, orders, resolutions, decrees, and circulars on local government at the commune level.
Some tasks are transferred to local authorities at the provincial level in accordance with the authority and capacity of the provincial level, tasks are inter-commune, inter-sectoral and have high technical expertise that the capacity of the commune level has not met.
