On October 9, Chairman of Tan An City People's Committee Vo Hong Thao said that he had just directed units to inspect and handle illegal constructions with the sign "Khong Thoi Gian" Ecological Zone built on rice-growing land in Huong Tho Phu commune, Tan An city, Long An province.
“The City People's Committee requests the People's Committee of Huong Tho Phu commune to preside over and coordinate with the Urban Management Department and the Department of Natural Resources and Environment to urgently inspect and identify administrative violations in the fields of land and construction... Thereby, promptly advise and propose handling of administrative violations according to the authority prescribed by law; the completion time is no later than October 15, 2024,” said Mr. Thao.
Previously, from June 2024, Tan An City People's Committee announced the conclusion of the Chairman of the City People's Committee at the meeting agreeing on a number of contents to handle administrative violations of the "Khong Thoi Gian" Eco-zone in Huong Tho Phu commune.
Accordingly, the Chairman of Tan An City People's Committee directed: After July 31, 2024, if the investor does not voluntarily dismantle the above-mentioned violating construction, the People's Committee of Huong Tho Phu commune shall preside over and coordinate with relevant specialized departments and offices to prepare a file to handle violations in accordance with the procedures and regulations of the law. Assign specialized departments and offices to inspect and review the suitability of the approved policies for implementation at the above-mentioned land such as mushroom growing facilities, conversion of crop structure on rice land, food and beverage business, etc. and advise the City People's Committee on measures to handle violations (if any).
However, up to now, the People's Committee of Huong Tho Phu commune, the Urban Management Department, and the Department of Natural Resources and Environment have not coordinated to fully implement the instructions of the City People's Committee for the "Khong Thoi Gian" Ecological Zone project in Huong Tho Phu commune.
As Lao Dong reported, at the land plots at location 49, Hamlet 1, Huong Tho Phu Commune, Tan An City, where this unit carried out the project, the "Khong Thoi Gian" Ecological Zone sign was posted and the land use function of agricultural land was not converted to commercial service land.
According to the land use planning of Tan An city approved by the competent authority, the plots of land in the above-mentioned area belong to the rice-growing land planning. Also according to the general construction planning of Tan An city approved by the competent authority, the location of the above-mentioned plots of land belongs to the low-density residential land planning. In the future, the area of the above-mentioned plots of land is planned for the construction of the extended Hung Vuong road.
Based on actual records at the above location, in addition to the warehouse approved for construction in 2020 for use as a mushroom growing facility, in 2021, the business owner built a number of temporary structures. Specifically, there are 8 wooden stilt houses, temporary wooden columns, thatched roofs with an area of 20-30m2, 10 thatched huts with an area of 20m2, 2 thatched huts with an area of 100m2 for trading and catering.
In addition, there is a hexagonal wooden hut, wooden pillars, assembled tiled roof with an area of 10m2 used for decoration and taking photos; a house with wooden pillars, assembled tiled roof with an area of 150m2 used for displaying wooden furniture and handicraft products. The purpose of construction is to serve as a business serving food and beverage.
However, the business owner has not been granted a construction permit by the People's Committee of Tan An City for all of these temporary structures.
In July 2024, the investor of the project with the sign "Khong Thoi Gian" Ecological Zone submitted a petition and documents requesting consideration of permission to invest and do tourism on agricultural land at the above location. On August 19, 2024, Tan An City People's Committee responded that the above proposal was not in accordance with the provisions of the law and requested the investor to dismantle the violating constructions and restore the land to its original state before the violation. If not complied with, it will be handled according to the provisions of the law.
