Hanoi Department of Construction has completed the third draft of the project on management, exploitation and use of roads and sidewalks in Hanoi.
Accordingly, the Department of Construction has coordinated with localities to conduct surveys, sociological investigations, and assess the current status of sidewalk management and use on 123 roads and streets proposed by the People's Committees of 16 districts.
Of which, 11 districts include: Hoan Kiem, Dong Da, Hai Ba Trung, Cau Giay, Tay Ho, Hoang Mai, Thanh Xuan, Ha Dong, Bac Tu Liem, Nam Tu Liem, Long Bien and 5 districts include: Hoai Duc, Thanh Tri, Dong Anh, Gia Lam, Dan Phuong.
The fee for temporary use of a part of the sidewalk for vehicle parking or business is determined according to Resolution No. 6 dated July 7, 2020 of the City People's Council, from 20,000 to 40,000 VND/m2/month.
From the experience of some researched countries and some domestic cities, Hanoi Department of Construction has proposed 6 criteria for sidewalk leasing.
First, the sidewalks that allow business must have a minimum width of 3m (except for special cases in the Old Quarter area in Hoan Kiem district); the sidewalk width must be 3m or more to accommodate 1.5m pedestrians, arrange technical infrastructure, partly for business and vehicle parking.
For the old quarter, sidewalks with a width of less than 3m are allowed, and business is allowed during the time of organizing walking spaces or other times licensed by the District People's Committee.
The next criteria are to ensure parking for guests on-site or within the permitted area; business activities must ensure safety and civility; ensure security and order, fire prevention and environmental sanitation; sidewalks where businesses are organized must be licensed by the People's Committee of the district or county regarding business hours and items.
In particular, mobile businesses must be equipped with sales counters according to the specifications issued by the District People's Committee.
District and county People's Committees need to consult with people before allowing sidewalk and street businesses or temporary parking to create consensus.
The draft also provides regulations on the exploitation and temporary use of a part of the sidewalk and roadway for vehicle parking. The issuance, adjustment and revocation of licenses for renting sidewalks for vehicle parking or business purposes are implemented by the Department of Transport and the People's Committee at the district level according to decentralization.
The license must clearly state the scope, time, and organizations and individuals allowed to use a part of the sidewalk to keep road vehicles or conduct business.
