The Ministry of Public Security is sending the Ministry of Justice for review of the draft (third time) Decree on administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points, restoration of driving license points.
Article 9 of the draft stipulates penalties for bicycle and motorbike drivers and drivers of rudimentary vehicles violating road traffic rules as follows:
A fine of 100,000 VND to 200,000 VND shall be imposed on a driver who commits one of the following violations:
Do not go on the right side of the road, do not go on the correct side of the road.
Stop suddenly; change direction without signaling.
Failure to comply with the commands or instructions of traffic signs or road markings, except for violations of regulations.
Overtake on the right in cases where not permitted.
Stop or park on the roadway outside urban areas where there is a sidewalk.
Driving in a road tunnel without lights or luminous signals; stopping or parking in a road tunnel in an incorrect place; making a U-turn in a road tunnel.
Driving bicycles and motorbikes in a row of 3 or more, other non-motorized vehicles in a row of 2 or more.
Bicycle and motorbike drivers using umbrellas, using hand-held devices and using phones or other electronic devices; carrying passengers on bicycles and motorbikes using umbrellas.
Driving a primitive vehicle between 6:00 p.m. the previous day and 6:00 a.m. the following day without using lights or without signaling in front and behind the vehicle.
Illegally parking on urban roads or sidewalks; parking on urban roads causing traffic obstruction; parking on bridges causing traffic obstruction.
Failure to comply with regulations on stopping and parking at road intersections at the same level as railways.
Using a cart as a mobile stall on the street, causing traffic obstruction.
Not giving way to vehicles on priority roads or main roads coming from any direction at an intersection.
Bicycles, motorbikes, and cyclos carrying more people than the prescribed number, except in cases of transporting sick people to the emergency room.
Loading goods beyond the prescribed limit, not ensuring safety, causing traffic obstruction, and obstructing the driver's vision.
Driving a vehicle on the road with a blood or breath alcohol concentration that does not exceed 50 milligrams/100 milliliters of blood or 0.25 milligrams/1 liter of breath.
Fine from 150,000 VND to 250,000 VND for drivers who commit one of the following violations:
Controlling a bicycle or motorbike with both hands off; suddenly changing direction in front of a moving motor vehicle; using your feet to control a bicycle or motorbike.
Failure to comply with the orders or instructions of traffic controllers or traffic inspectors.
A person driving a vehicle or carrying a passenger in a vehicle, holding on to, pulling, pushing another vehicle or object, carrying bulky objects; driving a vehicle towing another vehicle or object.
Not giving way to vehicles requesting to overtake when safe conditions exist or causing obstruction to motor vehicles requesting to overtake or causing obstruction to priority vehicles.
Failure to comply with traffic light signals.
A fine of 300,000 VND to 400,000 VND shall be imposed on a driver who commits one of the following violations:
Driving erratically, zigzagging; chasing each other on the road.
Ride on one wheel for bicycles and motorbikes; ride on two wheels for cyclos.
Entering a prohibited area; a road with a sign prohibiting entry to the type of vehicle being driven; driving in the opposite direction of a one-way road or a road with a sign "No entry".
Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath.
A fine of 400,000 VND to 600,000 VND shall be imposed on a driver who commits one of the following violations:
Driving a vehicle onto the highway, except for vehicles serving the management and maintenance of the highway.
Causing a traffic accident without stopping, not preserving the scene, not remaining at the scene or not immediately reporting to the nearest police station or People's Committee, not participating in first aid for the victim.
Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath.
Failure to comply with the request for alcohol testing by an officer on duty.
Motorcyclists who do not wear "helmets for motorcyclists" or wear "helmets for motorcyclists" with straps not properly fastened when participating in traffic on the road.
Carrying a person on a motorbike without wearing a "helmet for motorcyclists" or wearing a "helmet for motorcyclists" without fastening the strap properly, except in cases of transporting a sick person to the emergency room, a child under 6 years old, or escorting a person who has violated the law.
