The Ministry of Public Security issued Circular No. 83/2024/TT-BCA regulating the construction, management, operation, exploitation and use of the monitoring system to ensure security, order and safety of road traffic. The Circular takes effect from January 1, 2025.
The Circular consists of 3 chapters, 14 articles and 1 appendix; applies to police units and localities; police officers and non-commissioned officers assigned tasks related to the construction, management, operation, exploitation and use of traffic monitoring systems; organizations and individuals related to the construction, management, operation, exploitation and use of traffic monitoring systems.
Some notable points are that the Ministry of Public Security assigns the responsibilities of the Traffic Police Department as follows:
Invest in, build and upgrade traffic monitoring systems within the scope of management and other traffic monitoring systems when assigned by the Ministry's leaders.
Implement management, operation, exploitation, use, maintenance, and protection of traffic monitoring systems within the scope of management according to the provisions of this Circular.
Preside over and coordinate with relevant units to guide, monitor, inspect and urge police units and localities to manage, operate, exploit and use the traffic monitoring system nationwide.
The police of provinces and centrally-run cities are responsible for investing in, building and upgrading traffic monitoring systems under their management, except for traffic monitoring systems implemented by the Traffic Police Department.
Implement management, operation, exploitation, use, maintenance, and protection of traffic monitoring systems within the scope of management according to the provisions of this Circular.
The Circular stipulates that the construction of a traffic monitoring system must comply with national technical regulations on monitoring systems to ensure security, order and safety of road traffic and the following requirements: ensuring timeliness, efficiency and economy; prioritizing the construction of traffic monitoring systems on expressways, national highways and road routes that are complex in terms of security, order and traffic safety or important in economic, social, defense and security development; prioritizing the use of transmission infrastructure that has been built in the people's public security; in case the transmission infrastructure in the people's public security does not meet the requirements or has not been invested in and built, the transmission infrastructure must be rented from a service provider; meeting actual requirements and being suitable for road traffic infrastructure; ensuring the ability to integrate and connect with traffic monitoring systems that have been built.
The traffic monitoring system is designed in accordance with the Vietnam e-Government architecture framework and the regulations of the Minister of Public Security on management, connection and sharing of surveillance camera data in the People's Public Security.
The construction, upgrading and transfer of traffic monitoring system software must comply with the regulations of the Minister of Public Security on the development, upgrading, transfer and maintenance of software in the People's Public Security.
Before being put into use, traffic monitoring systems must be inspected, evaluated, and ensured to meet technical and professional requirements.
The Circular stipulates that the unit managing and operating the traffic monitoring system shall exploit and use information and data of the traffic monitoring system to monitor the situation of security, order and road traffic safety; detect and handle violations of the law on road traffic order and safety and other violations of the law.
The exploitation and use of information and data of the traffic monitoring system shall comply with the regulations on management, operation, exploitation and use of the traffic monitoring system.
Organizations and individuals that do not have functions, tasks, or powers in managing, operating, exploiting, and using the traffic monitoring system, when needing to exploit and use information and data of the traffic monitoring system, must submit a written request and must obtain the consent of the unit managing and operating the traffic monitoring system.
