The Ministry of Public Security is submitting the third draft of a Decree on administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points and restoration of driving license points.
Clause 4, Article 41 of the draft stipulates the authority to impose administrative sanctions on traffic order and safety in the field of road traffic for commune-level police chiefs.
According to regulations, the commune police chief is allowed to fine some traffic violations for cars such as:
Parking a vehicle occupying part of the roadway without signaling with emergency lights or placing warning signs as prescribed.
Honking from 10:00 p.m. the previous day to 5:00 a.m. the following day in densely populated areas or in medical examination and treatment facilities, except for priority vehicles on duty as prescribed.
Stopping or parking on the roadway in a suburban area where the sidewalk is wide; stopping or parking away from the right edge of the road in the direction of travel in a road with a narrow sidewalk or no sidewalk; stopping or parking against the direction of traffic in the lane; stopping or parking on a fixed median strip between two lanes; parking on a slope without chocking the wheels; opening the car door or leaving the door open unsafely.
Stopping the vehicle not close to the curb or sidewalk on the right side of the road in the direction of travel or the nearest wheel is more than 0.25m from the curb or sidewalk; stopping the vehicle on the road reserved for buses; stopping the vehicle on the manhole of a drainage ditch, the opening of a tunnel of a telephone line, high-voltage power line, or a place reserved for fire trucks to get water; leaving the driving position or turning off the engine when stopping the vehicle; stopping or parking the vehicle in an incorrect location in sections with designated parking areas; stopping or parking the vehicle on the road section reserved for pedestrians to cross the road; stopping the vehicle where there is a sign "No stopping or parking".
Honking and revving the engine continuously; honking the horn or using high beams when encountering pedestrians crossing the road or when driving on roads through residential areas with operating lighting systems or when encountering vehicles going in the opposite direction or when changing direction at intersections, except for priority vehicles on duty as prescribed.
Failure to comply with regulations on stopping and parking at road intersections at the same level as railways; stopping and parking within the railway traffic safety corridor.
Stopping or parking at locations: At road intersections or within 5 m from the edge of the intersection; bus stops; in front of or within 5 m on both sides of the gate of an agency or organization with a road for cars to enter and exit; where the road section is only wide enough for one lane; obscuring road signs; where the median strip is open.
Parking a vehicle not close to the curb or sidewalk on the right side of the road in the direction of travel or the nearest wheel is more than 0.25m from the curb or sidewalk; parking on a road reserved for buses; parking on a drainage manhole, the opening of a telephone or high-voltage power line, or a space reserved for fire trucks to get water; parking or leaving a vehicle on the sidewalk in violation of the law; parking where there is a "No Parking" sign or a "No Stopping and Parking" sign.
Making a U-turn at a place where there is a sign prohibiting U-turns for the type of vehicle being driven; making a left turn at a place where there is a sign prohibiting left turns for the type of vehicle being driven; making a right turn at a place where there is a sign prohibiting right turns for the type of vehicle being driven.
Do not use low beam lights when driving in tunnels.
Driving below the minimum speed on roads with a minimum speed limit.
