Overtime pay for holidays and Tet
According to Article 107 of the 2019 Labor Code and Article 59 of Decree 145/2020/ND-CP, enterprises wishing to mobilize employees to work overtime on holidays and Tet must have the consent of employees (except for some special cases as prescribed).
Regarding salaries, Article 98 of the 2019 Labor Code stipulates that employees working on holidays and Tet during the day are paid at least 300% of their salary, excluding holiday salaries for day-time employees.
If working at night and working overtime at night, employees are also paid at least 30% of the salary according to the salary unit price and an additional 20% of the salary calculated according to the daytime work of the corresponding working day.
